    Be careful about staying until you are taken to court though as that may discourage future LLs!

    I don't know if they can find things like this out or not but if they can, you may be classed as 'bad tenants' by some LLs?

    well some further good news letting agent is happy for us to stay on if we can get the previous lead tenant to agree to sign over the deposit to us.

    so kidnap , torture signing lol

    If this is the case he will let us stay and we just need to make sure we can pay the rent each month ! kinda feel better but know their is still along way to go

  • Rob, you might have problems with Housing Benefit if the landlord only starts the tenancy from a current date. Wonder if the landlord could be also persuaded to backdate the tenancy to July when the lead tenant left ? In which case you should hopefully be due HB for part of July & all of August ...

    You'll need to get the new tenancy agreement into the housing benefit office as soon as you possibly can. Most councils do batch runs when it comes to HB payments (i.e. their computers do the HB payments on a certain date every 4 weeks/month) ... you need to make sure they've got everything they need to process the HB claim before they run the next batch of payments, to ensure you get some ££ through for the rent before the 19th September.

  • Total sympathy for you but feel this is all because the DWP is being cut back so much that there arent enough people to deal with the processing and complex benefit claims that are being received. The majority of claims are straightforward have the correct evidence and information and can be processed quickly. However, if the right information and evidence isnt provided or taken by the jobcentre it delays claims. This is all down to poor staff training and even worse ineffective managers not managing. I used to work for DWP and had alot of training, but they dont anymore, everything is being centralised which doesnt help at all. If you can sit down and talk to someone and they can help on a one to one basis it used to work. People just dont realise how complex the government has made the benefits system. With all the cut backs and new initiatives it just makes it worse for the staff to deal with. Everyones case is urgent but you cant keep reprioritising claims it isnt fair to most. Not sure how much it has changed but a crisis loan is that, it has to be paid back and the funds are limited in each financial year so it isnt a bottomless piggy bank. I do hope you get yourself on an even keel and best of luck but felt the whole link screamed, staff with little or no understanding or training or compassion and a rubbish computer system trying to cope with too many elements for basic and add on benefits - hope this makes sense :mad:
