    I'm a long-time reader of this forum but never felt the need to respond until now. I've received four freebies from Boffer (Doom 3, Annie Lennox cd, photo paper and free postage) and I want to stick up for them because I don't believe they've done anything wrong.

    Firstly, no contract was formed. It was free, and you need an exchange of goods to form a contract.

    Secondly, EVERY joke makes fun of either the audience or someone else. If you've ever laughed at jokes about Stephen Hawking, Stevie Wonder, Heather Mills, Jews, Muslims, fat people...etc, then you have NO right to be offended by the joke Boffer played.

    Personally I'm registered blind, and I will lose my remaining sight. I also wear hearing aids, I could lose my hearing too. I have absolutely no problems with people joking about my disabilities and I would be a huge hypocrite if I did.

    If you're having trouble conceiving I give you my deepest sympathy but I won't pretend that the topic is now sacrosanct because it isn't. My advice to you is to grow a thicker skin, you'll need it.

    In any event thats not the only issue, One issue is that we was encouraged to register all our personal details, stay up to midnight, order what looked like two small teddies and a USB drive only to discover that all we was in line for was free postage for yet to be announced items which we would also have to stay up to midnight for. :angry:

    Poor guy here thinks the free delivery is for anything on BigPockets Webpage.:rotfl:

    It was a bad tasteless joke. Sure no actual harm done for many but I can see it could cause some offence

    Well the feeling from some people (including papa-roo) was that Boffer was making fun of those who can't conceive.     With regard to staying up until midnight, ALL the freebies/deals go live at that time. The exact nature of the items aren't revealed until they go live, it's a risk you take when you decide to stay up late to see what it is. All that was said about the freebie was, it was a joke people might find in bad taste, and that it was unlimited in supply. The fact it was unlimited in supply should have been a clue that it wasn't going to be something phsyical (my personal thought was that it might be an e-book). When the page for the freebie went live loads of people ordered without actually reading the description and felt slighted afterwards. It said it was for cattle for god's sake!

    Sure, you could consider it phishing if you like but not in a legal sense. Phishing is covered under the Fraud Act 2006 but you need to satisfy the conditions of section 2 (Fraud by false representations). Note:

    (1) A person is in breach of this section if he—
    (a) dishonestly makes a false representation, and
    (b) intends, by making the representation—
    (i) to make a gain for himself or another

    Boffer didn't gain anything from it because the offer was free. You don't have to use the free postage if you don't want. They didn't even get your card details because there was no need to give them.
