okay...letters all written and ready for recorded delivery post tomorrow.....a quick extract:-
I would draw your attention to my letter dated 8 Dec 2008 to the original three parties concerned, in which I asked for evidence to be provided that I had any liability for the account in question. No such evidence has been forthcoming from any party. The statement contained in your correspondence of, and I quote verbatim:
“Our clients have informed us that they are unaware of any legitimate reason for non-payment of their account and although they would prefer an amicable settlement, will not hesitate to commence Legal Proceedings if necessary.”
does in no way constitute evidence to the existence or legitimacy of said account. In fact, it could be seen as harassment under the OFT guidelines.
If no evidence is provided within 14 days of this letter, I will assume that none of the above-named parties can provide said evidence and assume that this matter is closed and written confirmation of the same will be provided. Otherwise I will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.
We'll see what happens next....

Then you can 'sit back and wait' :beer:I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

Do you have anything in writing from O2 that you don't owe anything? You shouldn't need to prove you do not owe the debt, but if you can it may save time.
Write to Lowell stating that they are in breach of the Data Protection Act by holding incorrect information on you and passing incorrect information on to the credit reference agencies. Inform them you will be contacting the Information Commissioners Office and Trading Standards if you have not received confirmation that they will remedy the situation and remove your details from their records.
There may be some letters that can help on the standard template thread, but i can't really look right now.

Yes, I do have statements from O2 showing that I don't owe anything (in fact I just checked my oldest O2 account and they actually owe me £9.65 which they have overcharged me!) and will certainly be sending these, along with a template letter if I can find one. after my "prove it in 14 days" letters got to Lowell, BCW, MH and 3 on Monday, letter in post this morning dated yesterday from BCW confirming that Lowell have instructed them to close the account and take no further action, and that there will be no further contact with me:j
So, to everyone out there who is being wrongfully pursued by this bunch, stick to your guns, do it in writing, get your evidence together.........and tell them to poke off. And if you need help with letters I'll gladly post extracts/templates/etc. on here for you....
