    play.com tried this old one on me when i ordered a tv from them which was loads cheaper than anywhere else.

    i bought it and they cancelled the order. i phoned them they said they were not getting it in stock again ( a manager told me this) i said that within 2 weeks they would be selling them again, was re assured they wouldnt.

    within the week they were selling them again with a 'new' price of 100 quid more.

    it isnt a mistake on a couple sites as it clearly describes and shows a console with the 'bundle' , it has a different bar code and as people have had money taken from their accounts which incours interest the transaction must take place.

    their excuse of not having the items to supply is rubbish, they have 14 days to complete the transaction which they have entered into by taking your money.

    if they dont complete it then i would guess you can demand a simular item to the one you originally purchased.

    IMO, a contract has been formed if:

    - they have offered a product at x price (this could be in their favour)
    - you offer to pay monies (or gold or cd cases or bin lids...)
    - they take the monies (or gold or cd cases or bin lids...)

    Virgin have done all these and it is legally obliged to supply goods or compensate you for not receiving said goods. Its T & C's dont mean a thing if they infringe your statutory rights

    Tesco dont take your money until it dispatches the goods... Bad here, but good as you dont pay for goods you havent got

    I'm in the same position, and emailed them first thing to point out that not only are they in breach of their own terms and conditions, but also the Sale of Goods Act as they've taken payment.

    No reply yet funnily enough.

    I've now emailed them (twice - once for each cancellation - just to make sure they get the message).

    My hubby works in Environmental Health & Trading Standards Dept at a local authority and although he is not Trading Standards....he is going to have a chat about it with them at work on Monday.  I'll let you know what he comes back with.

    Thanks Hes. Virgin didn't have the picture on the site, so I guess they could claim it was just the game ???although "bundle" would suggest otherwise to me.

    When I go into the history part of my screen I can still pull up the order screen showing this bundle at £32.99.....and it let's me get all the way to ordering haven't bothered pushing my luck by trying to order one though).

    However, I shall save the screen shots as it definitely shows that I have order the POKEMON COLOSSEUM BLACK BUNDLE.

    What really makes me laugh is that some of you guys are such cheapskates (the ones who start to bring legalities into it). Don't you know the meaning of a 'get out clause'. It's like a 'get out of jail free card' on monopoly (the anology of monopoly due to me envisioning what most of you do).

    To the ones who lost out- sorry you couldn't exploit the error.. such a shame. Get over it, it was an error and not a true bargain. A bargain is where you get something lower than what others are selling for without a pricing error etc.

    Nice to know that people help each other and where there is a true bargain then it's good for all, but using exploits and errors is another thing altogethor.
