  • Still no email from Tesco yet re: cancelling (ordered 12.37pm yesterday lunchtime).

    If they have taken an order at £109 and are telling us there is no stock at £34/£39 then they are blatantly lieing and contravening Trading Standards Law and I guess Distance Selling Regs too.

    If this is the case they should be honouring the deal.

    I've just called my local Consumer Advice Helpline, not to complain, I was more interested in the legalities of the situation.

    I'm not really any more informed though, as chap dealing with me said he reckoned Trading Standards should look into it and he would pass it over to them.  :-/  He did say that people should get in touch with Trading Standards if they have had the same problem.

    Edit: Just wanted to point out (before anyone jumps on my case for involving Trading Standards) that my only reason for calling the helpline was to try to find out where the situation stood legally so that the info could be posted here and people wouldn't go down the route of thinking they had a case for complaint, when they perhaps didn't.

    think ill wait to see what happens first mate, they have sent me two emails but not one cancelling order YET, so ill wait and see before i make any decision.

    (Note: Not saying I'll use it in this instance just that I did some background reading).

    Distance Selling Regulations

    The right to clear information
    Before you decide to buy, the seller must give you the following information:

    The name of the trader, along with their postal address if you have to pay in advance
    [glow=red,2,300]An accurate description of the goods or services[/glow]
    The price, along with any taxes and delivery charges if relevant, and how long the price or offer remains valid
    Delivery arrangements (usually within 30 days unless you agree otherwise)
    Payment arrangements
    The right to cancel the order

    After you buy, the trader must also provide you with the following information:
    Written confirmation of your order (by letter, e-mail or fax etc) including the above information (see 'The Right to Clear Information) if not already provided, say in a catalogue or advert
    Written information on how to cancel, a contact postal address and details of any guarantees, warranties or after-sales services, if applicable
    This information should be sent to you by the time the goods are delivered, or before or soon after the time a service starts

    What does the Order require?

    Where goods are offered for retail sale, the selling price and, where appropriate, the unit price (e.g. 65p per 100 grammes) must be given to consumers in writing (including prices in catalogues, shops and online).

    How should price indications be given?

    When selling to the general public, all pricing information must be clearly legible, unambiguous, easily identifiable and inclusive of VAT and any additional taxes. Pricing information must be given close to the product; or with distance contracts (e.g. online or mail order sales) and advertisements, close to a picture or written description of the product. In relation to sales by telephone, price indications must be clearly audible and linked to the subject of the transaction.

    Promotions

    Promotional offers should be unit priced to reflect the single standard product.
    Retailers may give additional information if they wish i.e. the reduced unit price if purchasing a multibuy offer may be shown, as long as it is clear to which products it relates.
    Limited period promotions, which relate to individual products (e.g. 10% extra free), may retain the unit price of the standard product for the period of the offer. Retailers may give additional information if they wish - e.g. they may show the unit prices of both the standard and promotional products but they must be absolutely clear to which products they relate

    Offences
    If the seller is in business (rather than a private seller), he may have committed a criminal offence if he:

    sells goods which are unsafe;
    has given a false description to the goods i.e. a car sold with incorrect mileage (clocked car);
    gives a false description to the services he is providing e.g. falsely claiming to be a member of a trade association;
    advertises a misleading price;
    displays a sign which states ‘No Refunds’.

    If you feel that any of the above could apply, you should report the matter to your local Trading Standards Service before you return to the trader.

    What are the main elements that a contract must contain to be legally binding?

    There are several, but the most important two are:

    the offer - i.e. you see something in a shop you want and ask to buy it acceptance - i.e. the shop agrees to sell it to you at an the agreed price

    Misleading Prices - Consumer Protection Act 1987

    The law does not control the amount a trader charges for goods, [glow=red,2,300]but you are entitled to expect the price of goods to be accurately displayed in a shop, catalogue, or advert. If goods are incorrectly priced, you cannot force the trader to supply them to you, but you should report the matter to your local Trading Standards Department for investigation[/glow]

  • Placed 4 seperate orders (3 for colleagues) for the bundle with Tesco with 4 confirmation emails back. I have had two cancellations back but the other two orders have vanished from my Tesco account history, they aren't even in cancelled orders history ??? All 4 were showing as active yesterday.

    Have emailed a stock enquiry for the 109.99 'version' but reply may take 7 days, a 20 minute wait on telephone with no answer.

    Any Tesco customer service reps hoping for a quiet day?

    Hi I ordered on from tesco at 10.15am yesterday. Wow this post has been bumped up or what, it was only on 3 pages yesterday at this time.

    Anyway, have been reading with concern. Tesco's t&c now state this about incorrect pricing, especially underpricing.

    1. Prices
    The prices payable for the items that you order are clearly set out in the web site. If, by mistake, we have under-priced an item, we will not be liable to supply that item to you at the stated price, provided that we notify you before we dispatch the item concerned. All prices are expressed inclusive of any VAT payable unless otherwise stated. The price of the items does not include the delivery charge which will be charged at the rates applicable at the date you place your order and which will be displayed in the 'Help' section of the web site. Where items are ordered pre-release, an estimated retail price will be given, in which case the price charged may be different, as the order may have been placed as much as three months prior to release.


    lets see what they do now. Their website still shows rrp £34.99 our price £109.99(surely breaking Trades Disc Act as it is a misleading price)

    Ive not had any further emails from them since having my order confirmation email. Fingers crossed :P
  • Just spoke to a Tesco rep who informed me that Nintendo have pulled out of supplying this bundle. When asked about the fact it is still on web at 109.00 she said that this is also unavailable and if ordered at that price, you would get an email cancelling it within 24 hours. The website is waiting to be updated and the product will be withdrawn for good - let's see shall we.

    If Nintendo won't supply Tesco, will they supply anyone?

    Just spoke to a Tesco rep who informed me that Nintendo have pulled out of supplying this bundle.   • This is what Tesco are now selling, however they have re-named the product and it does not show a product number / barcode so they will prob say it's a differnt product to what we have ordered! ???
