so can i assume my two confirmation emails and the debit to my account are good enough for me to have a case to argue with Virgin?

    Hes

well i'd say yes (but i'm not a lawer). the contract was made and they broke it. They cant just give your money back, because they feel like it! Otherwise every company would advertise "PS2 50p!" then when you get there they say "nah, were out of sock now..."

  • Nice moralistic first post. Not.

If it was a pricing error then they would have cancelled sayign so but they didn't. They said no stock was available yet Tesco were taking orders for the higher priced item.

If there's a loophole or they have broken trading standards then why shouldnt we exploy it? When they start charging the same price for an item as everywhere else in the world then its fair comment. Until that time we live in rip-off Britain and should take these companies for what we can get. Why should we pay £13 on the High Street for a CD when in Vancouver they are £7-£8?

Don't you know the meaning of a 'get out clause'. It's like a 'get out of jail free card' on monopoly (the anology of monopoly due to me envisioning what most of you do).

your obviously on another planet - perhaps you should skin up a few more "joints"?? 8)

Every country has a different infrastructure for the economy. If in the UK we pay more for petrol, in the US they have many more types of taxes. Go to JFK airport and they'll charge you for using the trolly alone. In the UK it's free. Where health insurance is just ok in the UK, in the US it's virtually a need. It's like comparing a cat and a dog.

The basic point is that they have a get out clause which doesn't affect your statutory rights because if it did they would not have it being such large companies.

p.s. that monopoly thing was just a joke so don't take it to heart... unless you actually do that of course!

    "Nice moralistic first post. Not."

    Nice exploiting 173rd post.

What really makes me laugh is that some of you guys are such cheapskates (the ones who start to bring legalities into it). Don't you know the meaning of a 'get out clause'. It's like a 'get out of jail free card' on monopoly (the anology of monopoly due to me envisioning what most of you do).

To the ones who lost out- sorry you couldn't exploit the error.. such a shame. Get over it, it was an error and not a true bargain. A bargain is where you get something lower than what others are selling for without a pricing error etc.

Nice to know that people help each other and where there is a true bargain then it's good for all, but using exploits and errors is another thing altogethor.

Nice to see you've missed the point completely, if they have broken the law they have broken the law, i couldn't care less if i got a gamecube or not really, its the way they went about letting people know about it, if it was a genuine pricing error they say so and most of us would be happy with that, some ya win some ya lose, but telling people they are unavailable they relisting them at a greater value is just wrong.

Large companys will just keep doing things like this over and over again till they are told that its not on.

To be fair though, Virgin pulled the item from their site and are stopping people buying it (at any price).

That's not to say they wont put it on sale again at a later date, mind you but I don't think that's as bad as Tesco who blatently just immediately changed price and continued to take orders. :-/

As far as i'm concerned, i bought this 'Gamecube Package Deal' in good faith off the Tesco.com website.
There were other online retailers offering the same package for very similar prices, i chose to shop with Tesco.
My order went through, i got a confirmation email, then Tesco decide to increase the price, then remove the product.
If Tesco do not honour this transaction then surley they are guilty of false advertising?

I'll wait and see what happens before i make a fuss.

Again, the get out clause is their way out. No two ways about it. God knows, if companies make such mistakes on a large scale then trading standards will probably kick in. If you actually look at the number of errors they make relative to the correctly priced items chances are it will be very small. So from this their clause still stands and they make this crystal clear.

If they give you your money back then it's the end of the contract.

    Depends how desperate you are.
