ebay seller increasing P&P

Hi, wanting some advice for an ebay purchase please.
bought a 'buy it now' package of three new PC games, listing stated that there was an option at checkout to just have discs sent, with no packaging, for less postage, if buyer wanted, which we didnt.
Bought the item, but at checkout the only options for postage was the one on the listing (£3.79) and 'other courier' for £4.99, nothing about with/without cases.
As it is a gift we wanted it with packaging, so emailed the company immediatly after paying to check and confirm this before they dispatched offering to pay extra if necessary, they responded saying it was too late, they had dispathed, without cases as we had not chosen the postage for 'with cases' then adding it would take up to 16 days to arrive (from a UK based seller!!)
To be honest if I need to pay more postage i will, all be it begrudgingly as I do not think the listing was clear, and the full postage was not shown until paypal checkout, (I assume the 'other courier' price was for getting the games in the cases with manuals), but the listing WAS NOT CLEAR.
the seller says they offer a 100% guarantee, but only of I send the package back at my expense and re order.
What can I do?
I feel the listing was very unclear, I also see that the same seller has listing that are shipped from the US, Australia and Canada, (although my listing stated UK).
Any help would be appreciated, thanky you. If you want more details then let me know.

Hm, strangely remeniscent of a bootlegger.
Have you scrutinised their feedback?My TV is broken!

Oh no, I thought I did check, i usually do, but it was late, in a hurry, now regretting it! their feedback is 97.5 on 344 feebacks, had I taken notice of that I would have avoided them totally!!
Lots of feedbacks about items not coming in cases even when requested, items being shipped from Tortonto, even when listing said UK, etc etc.
I could kick myself!
Any thoughts on what to do next?

Now also noticed that they have gained all this 300-odd feedback since july 17th this year!! (but have been registered since 2006...in Canada)
So how do I complain to ebay, under what heading would you suggest? item not as described, unfair charges? Should I wait till it arrives and see if I can tell if its bootlegged?
Distance selling act...would that only be applicable to UK based companies? (even though item stated coming from UK, they obviously have outlets in a number of countries, and are registered with ebay as based in Canada.0 -
Sit tight until something arrives, then see what you're dealing with. There's nothing meaningful you can do when the item's in transit anyway.
When an item arrives, check if it's legit.
Did the listing state that the items were boxed, new, sealed etc?
Check the stated item location on the listing - compare this to where the package has been sent from - if it differs, report them.My TV is broken!

Its a very long listing, mainly 'copy and paste' details about the three games, although the listing title uses the word 'new'-(which it will be if it turns out they burned it to CD themselves!) and the phrase '3 pack' (a pack perhaps in hindsight does not necessarily mean 'original case'
The picture is a library image of one of the games, which on closer inspection has foreign writing on the box! spanish I think?
Oh boy, is this learning me a lesson, I am usually so hot on checking feedback, and the one that slips through the net, ends up a nightmare!
Need to forget about it for now, or i'll start ruminating on it while im trying to sleep, and its just not worth it, life is too short and I have a birthday party to organise (probably minus one present now)!
OH has just pointed out that perhaps they avoid sending cases out as the cover sleeve would probably have a hologram of authenticity, which is more difficult to make, if indeed they are a dodgy outlet.
Well, no more speculation, i will have to wait and see.

Yes sorry fay, I will amend my original post, it is a PC game....we bought three games for our sons birthday at the same time (thankfully not from the same seller!!!!!!), its the other two that are PS2s, my mistake.
I think I was quite stressed when i wrote my original post!

In hindsight looking through the listing you can work it out, but its not clear, why not say '£3.79 is just for discs, all our listing will automatically be sent without their original cases or instruction manuals, unless you opt for the £4.99 P&P'
In any case, now I see some feedback where even the higher P&P rate was paid and buyer still did not get the cases!0 -
