firstly, thanks for a very informative thread - i've been right through it (admittedly not with a fine toothed comb) but cannot find the answers to my specific concerns. i will contact ccca again but i did try about a year ago and found them very judgmental and unhelpful, despite what i read everywhere.
long story short, i have been in debt all my adult life, and now i think bankruptcy is the only option. i do not want to owe anyone anything anymore, or borrow ever again - let's just say that i always had the best intentions but they never came off. all together i have probably about £13k in debts & CCJs, about £1500 in benefit overpayments (i'm told, but do not have the details, and these are from over 10 years ago), and around £28k in student debt (which i know can't be written off, and that's okay).
i am one of very many who is having a lot of trouble finding work; i havent paid NI for probably 6-7 years as i was a student for 4 of them and not working the rest. in all that time i've been ineligible for benefits, and so (stupidly i guess bcos of the NI) i don't sign on. my health is not it's best, and isn't helping with the job situation either.
my OH earns between £16500 and £21000 a year - depending on how much overtime he can get. and he works long hours and works hard. i totally live on him. i have no savings or income.
we don't own a car and most of what we own is 2nd-hand - we don't even have a bed - we sleep on a mattress on the floor...
i've tried to keep that brief...!
what i am wondering is:
(1) most importantly, if i go for bankruptcy, is my partner liable for any of it? meaning, would they take anything that belongs to him (ie 2 laptops & a desktop computer, television, MP3 player, disco/karaoke equipment)? although i use most of these things, they are his and none of my debts are his fault. the majority of the furniture and books and bits and bobs are mine, but there is nothing of any value. basically, if we parted ways tomorrow - any of this "entertainment" stuff would be gone, in fact, come to think of it, apart from what's in the kitchen, a couple of hairdryers and a toothbrush anything electrical belongs to him!
(2) also, whilst i accept that things may need to be sold (tbh i'm trying to sell things on ebay just to get by), what, apart from maybe keeping necessities like a fridge, stove, bed(!), maybe sofa - can i expect to lose? i accept it needs to be done, i just want to prepare myself!
(3) what happens if i am able to get work during the bankruptcy? do they give me enough to live on or all of what i earn? i ask this as traditionally i tend to work freelance....
(4) until recently we were planning to get married at the end of the year, in california. a few of my relatives were going to put together the money for the fares and officiant, and we would be staying with cousins out there. would the court look badly on this? if i go bankrupt should i be waiting to get married? i can see that this sounds like a stupid question but it's not a traditional wedding - it's more about where and when it is than all the extras like cakes, jewellery, outfits, flowers and all of that. personally i can't see ME spending money on it, although the OH will pay for the day to day expenses.
(5) finally, finding the money to pay for this is difficult. i was given some money i was owed (technically it's my partner's) and i won some, and if i withdraw my premium bonds i will justabout have enough to cover all the fees. i know it's difficult to answer, but i wonder, based on what i've written here, what the chances are that it will be accepted or refused. it's a hell of a lot of money to lose if they refuse it. naturally i'm going to be as co-operative and as honest as i can be... one of the creditors i have is particularly sneaky and bullying and i wonder if they can also do anything to mess this up.
i realise, okay, it took me 25 years, that i am not someone who can handle borrowing, even if i have the best intentions to pay back. i have done countless hours thinking about it. i am in my forties now and want a clean sheet, and to keep it clean. if i can't afford it, i don't want it. my partner can live on practically nothing and my aim is to follow his philosophy. i don't need anyone to judge me, i've made my mistakes as i'm sure everyone has and i am at peace with them. i am ready to move forward and be more sensible with my finances and prepare for my future, but hopefully without the spectre of my past debts over my head. if i'd've murdered someone at 18yo i would be out and free by now. :money:

I need some help and advice on bankruptcy, i spoke to the national debt helpline today, but having to wait for the information packs through the post can take some time.
I live in London and have recently been made redundant 4 weeks ago, my main question is, if i file bankruptcy and they reject it, do i lose the £700 which i have to pay for court fee etc?

Hi jobless_guy86 and welcome to the BR board. You won't be refused BR if you are Insolvent and the general rule is that you must have taken advice, that can be from the debt charities, an IP, an Accountant or a Solicitor. The Judge just wants to be sure that you can never come back and try and overturn the order on the basis that you were not aware of all the consequences.
I'm glad you've contacted NDL, they will go through all your options with you and if they suggest bankruptcy then come back to this board and we will help you all we can. Also if your not ‘clicking’ with one of the Debt charities do try another. We advise you to try at least two for your own piece of mind.

I wonder if anyone can help please, i am considering going bankrupt, i am in scotland and the dbts amount to more than £40,000. this is the result of a divorce, my ex is refusing to accept any of the debts, this has be going on for 3 years, this is a prospect that scares me silly to be honest, but i cannot make any of the repayments, i am supporting my sons, one is leaving school, and the other is going to the army soon, i am paying up a car to one of my relatives i need this to get to work and to get to my parents who are both ill, i am frightened that i will lose my car, and also will i get insurance for this if i get to keep it, i have a small pension, and am now getting csa money as well will this be taken into account as well, any help or advice will be very much appreciiated..0

Joseph, contact one of the debt charities mentioned in the first post of this thread and get some advice. If you post over on the Debtfree Wanabe board they may also be able to help you.
