Bank Charges Financial Hardship Disussion

Hi, I have with NatWest a £2000 loan and £400 overdraft, and I had agreed to pay them £200 per month. This covered my loan at £65/m and arrears by overdraft reduction over 6 months, but I could only afford this because I live with parents. £200 is actually most of my income from incapacity benefit, and I only agreed to the above terms to avoid going bankrupt.
I recently decided however to spend all of my income on improving my health, and so I asked NatWest to go ahead and file a default. I've since received demands for either payment of the overdraft by the 8th of October or a CCJ, and either payment of £200 loan arrears by the 19th or a default.
I've calculated that at least £400 of my debt is the result of bank charges, and tbh I expect my health won't improve in the foreseeable future. I think therefore I qualify for financial hardship, but my concern is whether NatWest will still file the default and ccj while my hardship claim is in progress. Will sending a claim letter prevent either of these actions?0 -

What stage are you at? Is it the first letter you are sending asking for the funds back? Why have you not got the student account(interest free overdraft)?0 -

Brian, I think your case is 50/50 since the debts you have are non priority ones, i.e.. the worst case scenario is a CCJ. I am assuming your income goes into a non RBS Group account so that they do not offset it.0 -
Guys,
i was made bankrupt in April 2006 and have been discharged in April this year.
From what date can i reclaim my bank charges? April 2006 or April 2009?
Thanks0 -

HAILFAX
Amount hoped for around £1800, offered £455
I phoned Halifax about two weeks ago after reading all the info here and after 2 mins on the phone they said they would send through forms etc. I recieved nothing through the post until a letter dopped on my doorstep with an offer of £455. I called straight away to find out why they had come to this amount without even asking any questions and they said that the amount is the charges paid since the account was with the "collections department" or someting and would not budge. I was very angry they had decided this without any investigation into my financial hardship case.
Priority arrears: Mortgage = £7900 // Council Tax= £1015 // Elec/Gas= £600
Non Priority = £27000
Im due in court on 21st October for a repossesion hearing, Council Tax is with the Bailiffs and im getting threating letters from Scottish Power.
After pleading with several people on the phone to "hear my case" I thought I was making headway when they asked me to fax over the court papers, bailiff letters and budget planner. This took me a great deal of time to sort out and fax only for them to turn around and say they didnt feel my hardship case was bad enough to increase their offer but.....if after the court hearing things got worse i should contact them!!!! Get any worse!!! Are they taking the urine. If they paid that money back now I could at least show to the judge that I was making inroads on my mortgage payments but Halifax would not budge.
My overdraft is £1200 and I even said if they paid back the charges I wouldnt mind if they then cancelled my overdraft but nothing, nada, finito.
I just dont know what to do0
