Hi,yes, the priority debt arrears were going out of the Smile account. We now pay our priority debt by our Smile debit card as we only pay when we have the money. Some of the arrears have been added on to our monthly payments, but as I told the bank we cant afford them & we are 1 month away from repossession. The bank have agreed that we are in financial hardship & are still charging us £30 each time we miss a payment! We dont have an overdraft as they have taken £40 each month for the past 12 months to pay off the one we had!Even if we could get the charges frozen would at least be something.Help!!!Sorry for the rant!!natweststaffmember wrote: »Financial hardship is worth going down and I haven't finished with you yet

Were the priority debt arrears going out of the smile account?
Were any of the arrears being paid off?
Is the Smile account your main account?

I am going to go back one step further. What lifestyle event in the last 2 years, for example, caused there to be insufficient funds to cover the priority creditors?Hi,yes, the priority debt arrears were going out of the Smile account. We dont have an overdraft as they have taken £40 each month for the past 12 months to pay off the one we had!Even if we could get the charges frozen would at least be something.Help!!!Sorry for the rant!!

Hi,thanks for getting back to me.The arrears really started about 2 years ago when I was diagnosed with epilepsy & couldnt work. However I am now working but I am self employed & my income varies from month to month. My husband had to take a 12.5% paycut in february which really put a dent in our money, that & the continuing bank charges!natweststaffmember wrote: »I am going to go back one step further. Hi there. i have had £500 + bank charges within a year. i have just recieved the expenditure form from halifax to fill out. At the back off the form if i state that i have had £500 + charges in a year is this enough to claim under financial hardship??0

I think we might have an argument on the February pay cut of 12.5%. With the epilepsy it will be difficult to go back 2 years since you then went back to working but your OH getting a paycut plus the difficult times we are living in perhaps might give us February as a starting date.Hi,thanks for getting back to me.The arrears really started about 2 years ago when I was diagnosed with epilepsy & couldnt work. However I am now working but I am self employed & my income varies from month to month. My husband had to take a 12.5% paycut in february which really put a dent in our money, that & the continuing bank charges!
If you can argue that the charges since then directly caused priority debt arrears then we might have a case to ask the FOS to relook at it with evidence.0 -
Having priority debt arrears(mortgage/rent, council tax, utilities) and a negative bottom line figure might be even more helpful.hatebankcharges wrote: »Hi there. i have had £500 + bank charges within a year. i have just recieved the expenditure form from halifax to fill out. natweststaffmember wrote: »To be honest, since there is no priority debts then I think that is a fair amount. However, do you have any credit card/store card/ catalogue charges you can reclaim in the meantime?
Hi all,
I have put claims in for charges on my credit cards and started claims at weekend for ppi reclaimation.
Was wondering if anyone can help with a point regarding Abbey bank reclaim. The letter I received with the offer of £360 as a good will gesture has a different claim number to the one that the court stayed in 2007. At the end of the letter it says "Your complaint under reference number CMS****** remains on hold pending the outcome of the test case. We will keep you updated about the proceeding."
Am I right in assuming that this claim is still valid if I accept the £360 goodwill gesture. The £3100 was from 2001 till 2007. The £360 is charges from the past 12 months.
Thanks in advance for any help given.August 2009 - Debt free - August 2013
