Reading that as i have recieved over £500 in charges i could claim under hardship rules, i wrote to hsbc to tell them so.Unfortunately i still have to show that i am in hardship via an income and expenditure form. The fact that my partner pays the rent but i pay for everything else makes me look like i spend loads of money on non essential items so will never succeed. Is there any way to get round this?0

I have just received a letter from Alliance and Leicester stating they can't give me the full amount until the test case has been resolved, but they have paid me back £355 straight into my bank account as I claimed financial hardship and any future charges will be automatically charged back in to my account.
I have to say a big thank you to Martin Lewis for campaigning this now for the PPI on my loan that I have with Welcome and see where it goes.0 -
Am still managing to pay most of our bills so it looks like a dead end. my credit rating will be ruined and i just want them to stop charging on top of charges so i can get on top of things you know. Grr. Thanks anyway0

ok,here we go
i owe £6.000 on my credit card which fell into default, i agreed to pay £50.00 a month but that also fell into default,i still owe approx £6.000 on this credit card with the halifax
the halifax owe me £6.000 bank charges over the last 6 years on a seperate normal visa electron account.
the question is ? will the halifax pay off the credit card debt with my bank charges if the court case is won, or will i recieve the bank charges into my normal visa electron account,will the halifax just take the charges to pay off the credit card ????missed direct debit charges,very odd,theres no pain so how come the big gain,i.e £39.00 for a letter0 -
I have recently gone with a debt management company where i pay of £190 split between all the banks and comapnies i owe. Can i still go ahead and ask for my charges even though they are kinda doing me a favour by dropping the interest rates?!0

I wrote to Abbey re my financial hardship case, claiming back about £2500. i've just recieved a letter which says the following:
"We can see your Abbey bank account was closed more than four years ago, therefore, we beieve any unauthorised overdraft bank charges incurred prior to the closure have not contributed to your present financial situation. We therefore regret that we are unable to consider your request for a refund of charges on the basis of financial difficulty and we are unable to progress your complaint until the outcome of the high court test case if known"
so what should i do next? do i just need to wait?

I wrote to Lloyds TSB a while ago claiming financial hardship as at that point my lender was taking me to court for possession, they just got someone from Collections to ring me.
I read somewhere on this site that there is a dedicated place to put this sort of information but I can't find it anywhere!

hi all,
I'm new to all of this and so just wondered if anyone can give me some advice please.
a few months ago barclaycard took £200 out of my savings account which was with barclays bank. i had been saving this money for dire emergencies and had managed (so far) to keep out of using it.
i am now in financial hardship due to my long term depression and find myself unable to work. we, (my partner and i) are on employment support allowance and disability living allowance.
what i was wondering was, can i claim that £200 back on the hardship clause?
an adviser at the bank said "no, because it was in my agreement that they could take the money out without warning".
sorry if i have put this question in the wrong part of the forum.

Yes it is likely if the card is defaulted or in arrears. They can only pay up any outstanding arrears or defaulted amount tho the rest should come to you direct.LegalBeagles0
