    I would re send your letter recorded delivery this time but send another letter with it saying that the 14 days had elapsed but you are giving them a further 7 days from the date of your second letter (enclosing a copy of the first letter)

    just to give them the benefit of the doubt (Ha !) so to speak

    I wouldnt give them a futher 14 days as no doubt they will have got your first letter but this shows them that you do mean business and that you are keeping copies and will take it as far as you need to

    I am in the process of a second claim with HSBC claimed and got £500 in charges a while back but since then have had a further £800 am going the financial hardship route this time

    I messaged them through online banking and they told me to fill in an income and expenditure form and give them a ring which i am doing and will update you when done

    Of subject slightly but does anyone know how the Global financial crisis will impact the charges reclaim case if the banks are going under will they still pay out?

    i called the bank today and they have recieved my letter , they claimed a response would be with me by the end of this week ( no insight into what the response may be ). when i mentioned the 14 days , they assumed that i ment 14 working days !!:rolleyes:

    I put a claim in with the ABBEY around MARCH 2007 , after various letters and delays i fell into the everything on hold no can do brackit ..
    So after reading Martins advise on financial hardship criteria i relised that i fit the bill . I am on parental leave , we only have one income and we are overdrawn .
    After asking the Abbey to consider me for financial hardship , they advised me to go to the citizens advise and go through a financial review i,e write down incomings outgoings etc . Which i did i also sent them a letter explaining our situation . I was lead to believe if i can prove we have less coming in than going out and have statements to prove they would look at my case seriously . I sent everything off and kept getting a wooly no but nothing actually saying no your not in financial hardship . Then i sent them another letter saying why havent you actually wrote back to me and given me a definate answre ? And asked them to explain why they had come to there conclusion .
    Under the FSO rules they will deal with your case if the bank give you there final NO !! And they would contact them advising them to deal with your case ??!!
    So i pushed the Abbey after lots of phone calls and letters they paid out last week the full amount including intrest .
    My advise is the following;
    keep copies of everything letters bank statements
    keep all names of people you have spoken to
    write down dates times etc of phone calls makes life easier when calling a call centre
    DONT GIVE IN IF YOUR IN TH RIGHT
    make sure you fully understand what they want you to send ,make sure they tell you exactly what documents of prof required
    USE THE FSO THEY ARE ON OUR SIDE

    LISTEN IF YOUR IN FINANCIAL HARDSHIP AND CAN PROVE THIS GET ON IT TODAY THEY CANNOT REFUSED TO DEAL WITH YOU UNDER THE FSAS WAIVER RULE

  • Hi everyone, we applied to have the stay lifted on reclaiming bank charges as we were experiencing financial hardship. The court sent us a date for this to be heard and on 25th September 2008 it was decided that yes the stay could be lifted in view of our severe financial situation.
    The Judge concluded that if things hadn't been settled within 2 months it would come back to Court although he basically said he didn't expect to see us back as the Abbey would have settled out of Court by then. :rotfl:

    We completed the relevant financial forms received from the Abbey and sent a lengthy letter to them, explaining our case for financial hardship in that we had both recently lost our jobs in the travel business, having been in company accommodation, we also lost our accommodation and were living on relatives floors/settees on a rota basis. We were in receipt of Job Seekers Allowance and, short of sleeping in the car, didn't think it WOULDN'T constitue a case for financial hardship.
    Well SURPRISE SURPRISE !! the Abbey's solicitor phoned a day ago to say our case does not constitue financial hardship !!!!!!!:rotfl:

    Does someone tell me what does then...... we have no home, are living on 94.95 a week and cannot find somewhere to live as landlords who WILL take DSS, of which they are very few, are insisting on a deposit in the region of £1,600 !!!
    What I don't get is if the Court have already decided we are a claim for financial hardship how on earth can the Abbey say we are not ?? does anyone know who has the last say and what our next step should be.:confused:

    We are thinking of writing to the Court and letting them know what has happened and asking for the hearing date to be brought forward asap in view of our situation - does anyone know what the chances are of his happening?

    If anyone has any advice/help etc to offer it would be good to hear from you.
  • Having placed a claim with natwest , under financial hardship . for bank charges .... over £5000.
    i completed the financial statement they sent and sent documentation from my debt managment team regarding my financies.....

    18 k unsecured debt
    36k secured debt

    2 charging orders against my property.

    They contacted me for some additional info then told me that........:confused:

    That there assesors meet twice a week to look at cases but mine will not be forwarded on the grounds that

    a, We have made agreements with our creditors to make minimun payments?
    b, There are no reposession orders on my property

    This is crazy i said, unless i am going to be thrown out of my home they will not consider financial hardship? Wher'e is the sence in that

    could any one help or give some advice as to what next.
  • I applied for a refund of bank charges 10 weeks ago [NatWest]. They sent me a letter today saying that "following our review of the information you have provided, we have determined that you do not fall within our criteria which classify Financial Hardship".
    Since I live with £300/month, I would really like to know their criteria for financial hardship!

    I'm not quite at your stage yet though other folk have gone down the road of asking what the criteria are and what parts of the criteria they do not satisfy. They, the banks, are apparently reluctant to provide this info - perhaps because there are no criteria and they play it by ear and see what they can get away with.

    There is another thread on financial hardship too by the way....

    Hi, I have claimed financial hardship with RBOS. They accepted that I was in hardship but say I have to wait until the OFT has decided. What do I do? My husband claimed financial hardship with BOS/Halifax and they paid out 75% of the claimed charges within 2 weeks. Do I take RBOS to court?

    I am still waiting to hear regarding my application so am not in as strong a position to help. What reason has the bank given for having to wait until the outcome of the case?

    One previous poster asked the bank to clarify what specifically resulted in their claim being rejected. Have they backed the response up in writing?
