Letter received from Moon Beever this morning, reminding me that I have not paid the IPA from my nil tax code. I have emailed a response, including my OR in the email:
Dear Sir/Madam
Further to your letter dated 5th February 2009 regarding me not paying my IPA. I have twice contacted Mr ### at the Insolvency Office regarding this query.
My housing benefit was reduced by £100 because of the nil tax code that was implemented. According to the Council Office, they view the tax as income, regardless of the fact that I should be paying it to you. I spoke to Mr ##, who contacted the Council to explain that this did not constitute income as I had to pay it to you. The council responded by saying that their decision stands, and my housing benefit was reduced by £100, plus arrears taken of £9.15 per week to take the payment back to October when the nil tax code was implemented.
As I explained to Mr ##, if I continued to pay the £93 I would actually be paying from my benefits, which I can ill afford, and which I believe is not allowed as the benefits are to enable me to live. Mr ## said that he would speak to his supervisor and contact me again. I did not hear from him. I again emailed, asking for clarification regarding the situation, explaining again that if I paid the IPA it would cause me financial hardship. I have not heard from Mr ## again.
I cannot afford to take a reduction of £100 plus arrears in housing benefit and afford to pay the £93 per month - it would cause financial hardship to me and my children, and I believe it is not allowed to insist on an IPA when I am living on benefits.
As such, I will not be paying the £93 until there is a change of mind on the part of the council with regard to the housing benefit. I know I am not the only person in this position, and am surprised that there is not some agreement in place between the insolvency service and the local councils to handle such a situation.
I look forward to hearing your response.
Kind regards

Hi merry
I think it is about time the IS service just collected everybody's tax straight from HMRC at the end of bc year. Would make things a lot simpler for both us and them. Hope you get it sorted soon girl.
