Unfortunately insurers decide responsibility based on rules and not on context of each accident They don't really bother who is at fault. In fact, if they can reduce your NCB, it is good for them (they can charge higher premium from you next time).
Insurers don't lose any money. All payouts by them (to other parties) are distributed among all their customers in following year.
As long as cost of insurance remains much higher than penalty for being uninsured (usually 6 points & £200 fine), uninsured driving problem will continue.Happiness is buying an item and then not checking its price after a month to discover it was reduced further.0 -
I know its frustrating that you're unsure weather this other driver holds a provisional or full licence, but the insurance see it as you were in a side road & you were coming out to join the main road when you hit mainstream traffic.
At the end of the day you should have checked both ways constantly and have had your window open slightly to have helped to hear any traffic coming if you couldn't see it and to have been cautious of any traffic not willing to stop,,, (as I've had this drilled into my head on recently passing my driving test), should have looked again when thought about going when it was clear and shouldn't have pulled out until you checked again and then should have kept on checking until you went out and were level, making sure no traffic was coming from the side of any car that had just let you out.O0 -

How much have your premiums gone up? The car you hit could have been legal. Maybe the driver took a friends car. Regardless you hit them.
