It doesn't matter in the slightest though...Unless your conjecture is that his car was hurled sideways on to the front of your car, you should have been able to stop, wherever he came from...0 -

You know this place; everyone has a different opinion - in your case everyone actually agrees (apart from you) and that speaks absolute volumes.
It was you that drove the front of your car into the side of someone. He was certainly there before you pulled out because you hit him. If you didn't see him beforehand then the indication is that it is your fault; otherwise you would have seen the maniac careering towards you sideways before you pulled out
There was an uninsured driver here a few weeks ago and everyone gave the guy what for. If the guy that you hit came on here now, I'm sure he'd get a similar pasting. Like Tom said, there are two issues. Causing an accident is a different issue to driving outside the terms of your license - there are seperate penalties for that. You should both have to deal with the penalty of your own actions. His might be a magistrates appearance and a fine; it isn't the person that hit him getting away with it instead. There are processes and procedures for each and each must be followed correctly - we can't operate the justice system on a "tit for tat" basis, even if it seems to fit.Everything that is supposed to be in heaven is already here on earth.

You have a strange attitude to this.
You were the one who originally asked:Please let me know what your thoughts are with this case.
Look forward to hearing from you
Everyone has politely given you their thoughts, but seemingly because you don't like them you turn out to be just as thoughtless in your comment as it seems you were when driving.
What were you hoping for, coming to a moneysaving website? Did you hope we'd have a whip round to pay your premium increase or something?
From the straw poll of replies you have had, isn't the penny even begining to drop yet regarding your responsibility?0 -
I wonder if people would be more sympathetic if something along these lines is what happened... The OP would have looked and not seen the other driver if something like this happened.0

i said i understood, i was just lookin to see what other peoples views were on this...... looked on google for motor insurance forums and it bought up this site.
just wanted to know what peoples views were on illegal driving.
Accidents happen, i do understand that but the way people see me is that i pulled out on purpose into his path - which i can assure you i didnt....
Not expecting a whip round at all thank you, i am able to pay myself. lol
Whats the point in a law,

Nobody's suggesting it's OK to drive illegally.
And nobody's suggesting you deliberately hit him with your car.0 -

How could the scenario you painted fit the facts? The OP stated that the collision ocurred when she drove into the driver's door of the third party car? Or was it LHD?0 -
I'm not sure why Mickey is so surprised at the reaction. From what I can gather he hit another car but thinks that because the driver was a learner that he should be absolved from responsibility. If you hit another car, then you're wrong. If that car is driven by someone without a license then your both wrong. If you're hit by a car then they're wrong, if your hit by an illegal driver then they're doubly wrong.
You don't get let off the hook for breaking a law if the other person is also a law breaker (not that this is about breaking the law).
The odd thing is that the police have confirmed the guy was licensed so he wasn't even an driving illegally. But either way Mickey is in the wrong.
Now if the other driver was hit while driving dangerously, that might absolve Mickey. Sometimes it's impossible to avoid another car because the driver has driven in a way that would make it impossible for the other drivers to see. This is the only way you can avoid blame, focus on this not whether they're licensed or not.
Also, under anewman's diagram the car would have hit the first car that was turning into the road Micky was pulling out off.0
