I hate to say it but I'd have to agree with you there. I'm going to take out a new contract but not until this is cleared up and cancelled for definite.
Just had a call back from someone higher up in India. It would appear I have two investigations going on, one in Bombay, one in Glasgow. Anyway, this guy tried to ask me to send a scan of the box the phone came in to prove that they didn't send me updated t&cs! I told him that was ridiculous and I could be expected to have a scanner or something like that. I repeatedly asked for a deadlock letter, he kept saying no for reasons I did not understand. Then eventually when I kept repeating that I was legally entitled to one he said he would talk to someone and call me back in a couple of days. The case continues...

OTELO charge near £500 for each case refered to them, YOU need a DEADLOCK - thats why networks dont willingly give DEADLOCK - £500, but they HAVE too, OTELO will take a dim view of any network refusing DEADLOCK so consumer can refer the matter to them....go to OTELO & tell then DEADLOCK is being refused, it will work ( & 3 will get charged approx the amount of your outstanding contract, thus should you lose @ OTELO 3 wont make a profit out of you if you use all your plan allowance up ! KARMA LOL )
Hahaha, very interesting. Explains a lot, see my previous post. I think I spelt it out to him enough though, so we'll see what happens.

That is excellent information! If I don't get any joy, at least I will feel better about referring them to OTELO!

  • I am taking 3 to a) OFCOM b) OTELO c) Citizen Advice Bureau d) Court.

It will make sense if we are all togather and represent ourself as customer. 3 can bully us one at a time, but if there is representation they cannot bully us. They have cancelled several contracts, but saying no to others.

Come on people, lets get togather and everyone will benefit. I am taking the action anyways. They are extremely rude and liers. They will not transfer to cancellations unless you pay. If you are transferred by mistake, then excuse is that systems are down, please call back later on. Or worse, keep holding for hours and then they will rudely disconnect.

Please can you give feedback, if your contracts have been cancelled.

I'm going to see if they'll give me some kind of deadlock ref, but I don't hold out much hope. I'll try OTELO and maybe consumer direct (trading standards) on the phone tomorrow. No one has mentioned trading standards yet. Might be worth a try.

I would still like to know if anyone has cancelled a mix and match deal under these revised T's & C's.

The woman in glasgow claimed that if someone has cancelled a M&M then it was an error and shouldn't have happened, but I would have hoped that this would at least give you some ammo to claim that if one M&M was cancelled, then why aren't the others ?

I'm afraid she is right about the per minute billing, mix and match has always had it so I'm afraid its not looking likely that you'll be able to cancel. No harm in trying though!

that doesn't do me any favours - i'm think i'm going to have to go cap in hand to orange and beg them to be let out of the contract - the bloke in the shop said there was no cooling off period, even though i did explain the situation to him.

I know it's my fault for not waiting but i'm just really frustrated and fed up by this ..

I know exactly how you feel. I have been tempted to do the same, and I'm on a contract for which this actually constitutes a change in billing practice.
Surely orange must let you out somehow. Its only been 4 days since you took it out right? Good luck, and let us know how you get on.
