there terms and conditions clearly state to cancell it needs to be in writing, read my emails with them an you'l see i got fobbed of too but i persisted

i started with an email then more emails then they called an i missed it so i called back an selected the option for cancellations but its not its retention (as most of u know) and it took me bein in a que for 25 mins then 15 mins talkin to them for them to tell me this after me arguing calmly that im entitled to cancell due to there t's & c's an transfer me to the correct department after a further conversation with this dude in bombay if thats were it is then goin through the whole you already new this was gona happen when you renued an me sayin but thats also irelevent as circumstances change and the fact it wasnt actually implimented at the time an your t's & c's clearly state the contract can be cancelled within 30 days of the letter's date if it is detrimental an then him saying as iv not used the phone for 8 months i cant cancell as its not detrimental to me an me stating that its irrelevent as i could start using the phone as im paying for it then it is detrimental and that his excuses are just circumstansial an me lying that i dont use the phone as i use my house phone cus he wanted to no why i wasnt using it (im with o2 now not 1 problem thats not been resolved the same day) so anyway he then puts me on hold for another 10 mins an comes back an gives me cancellation dates an confirms im not liable for the cost of the rest of the contract and i can keep the phone, i asked for this in wriring an he said i had to email in again for that
persistance is the key - dont let yourself be fobbed of try an keep to writing only as it creates a paper trail i was lucky with my phone call but it took me well over an hour0 -
just been on the phone to OFCOM actually and registered a formal complaint.
He did agree with me that the change to per-minute billing is a "major" change and understood that I had a point with regards to them implementing the change last year and only now telling us.
Can anyone else who has a letter just tell me when they've said the date the change was implemented ?

I've received a standard reply fob off email from the executive ofice -from Lesley to be precise, i responded with this.
Dear Lesley,
I'm afraid that your communication is far from sufficient and is merely a repetition of what I was advised previously,
You state this :
As discussed, our intention to introduce First Minute Billing was first detailed in our Pricing Guide on 25Th October 2007. This advised that all calls made are initially rounded up to the first minute and are billed per second thereafter
Your terms and conditions clearly state ,
If you are a pay monthly customer we will let you know at least one month in advance if we decide to ; make any variations to your agreement which are likely to be of detriment to you.
I certainly wasn't advised of this change when your new price guide was released in October 2007 or I would have gladly cancelled at that point. The June 08 price guide states that you charge per second for a promotional period up to 30Th June 08, why is this the case if it was already changed in Oct 07 ?? Whilst you do make the price guide available on-line it is unreasonable to expect customers to check it several times a year during contract. (which is how often it appears to have changed recently)
When I upgraded in June I asked if everything else was staying the same to which I was advised it would be, yet the customer service representative must have already known about this change. At that time I did not have Internet access and had to rely on the honesty of your staff member.
I will be taking this matter to Otelo, and to do this I believe I need a deadlock reference number. Whilst this may be 3's final position on this matter I certainly feel that you have at least broken the terms of my original contract in October 2007 by not notifying me of the change then. Also, if it is in fact the case that I'm unable to cancel now because the change occured then, why are you notifying me now ?
Please forward the deadlock reference number promptly as Im keen to end this matter as soon as possible,
its not my best peice of work but all i could manage with the kids pestering me

my letter is dated for the change to be implimented september 23rd 2008 not 2007
and the postage date was 5th august 2008 although i got it the 14th0 -

One wwk after receiving my PAC I had a call today from Three offering a new deal to stay. First a £5 per month for life offer 250 mins 50 texts, no handset. Said I needed more mins and text, was offered a SE K850i for £15 per month 750 mins 150 text £5 downloads 50 video mins on a 12 month contract. Said I would prefer nokia and liked the N95 so he offered a Nokia 6220 for £25 per month with 750 mins 150 text £5 downloads and 50 video mins. Told him I needed to look at the phone he plans on calling tomorrow.
Can anyone tell me how many calls it took to get the N95 out of them?0 -

3 do the n95 for £20 mix n match 300 18 months although i dunno why u wana stay with them but each to there own ay!, you should be able to get unlimited tx's for free too as there givin those add ons out as retentions deals0 -

yep i have asked her for it in writing. should i have got a complaint ref no? I'll email them for one if I do.0
