liar seller refused full refund as he had received return item.

    I dont understand if you have opened a dispute with paypal then just inform paypal that you have returned the item via special delivery, also that you have spoken to Royal Mail that they have tried to deliver the parcel but the person was not in. Most times when people send me stuff I have to sign for I cant do that till Saturday which is the only day I can go to the depot, I certainly wont say yes I have received it just cause you have sent it and there is a card...what if I say yes I have received it and go to the depot to pick up the parcel and it turns out to be emplty.....look it works both way.

    You have done the most sensible thing by sending it via special delivery. I recently opened a dispute against a seller and Ppal told me to send the item back and when I did paypal asked me to fax them the proof of postage which was the recorded delivery slip i photocopied it front and back and faxed it off to paypal....I got my money back from the seller.

    Read posts by pinkgem and Armchair tycoon...as long as you have the ref number just email paypal with your dispute number and say that royal mail have tried to deliver the parcel and no one was in to accept it and that they left a card this will also be on the RM website....

    Go to 'My Messages' and send the seller a message explaining that Royal Mail has tried to deliver the item and have left a card, if he doesn't contact Royal Mail within 7 days of the day the card was left they will return the item to you, if it is special delivery and 2 weeks if it is standard recorded, he may well be a seasoned con artist and will no doubt know the system a little too well.

    On the 6th day after the card was left contact Royal Mail and pretend you are the seller to see if re-delivery has been arranged, it not try and arrange it for a Saturday, you may catch the seller off guard and they might end up accepting and signing for your phone.

    When communicating with the seller or PayPal avoid calling the buyer a liar or other inflammatory language, no matter how much you are annoyed, people are less inclined to take you seriously when you appear to rant, you want PayPal to take your side but you don't want to give them the impression you are an unreasonable person that may be partly to blame for this situation.

    Under no circumstances should you give the buyer the tracking number, they have no right to it, no matter how much they may protest, Royal Mail on occasion deliver secure items and neglect to get a signature or put it on their website, you don't want the buyer to get a heads up on this if the item does get delivered but has no tracking, as he can use this to his advantage.

    thanks. the problem is the seller can refuse to collect item or arrange redelivery. I have no idea.
  • Sysboy don't take offence but I think most of the people here who have offered sound advice are banging their heads against a wall trying to help you, all the answers you require have been posted here, we cannot pull from thin air a new solution to your problem, your options are posted here and I suggest you read through what has been said and act upon it, you are now covering old ground in your question.

  • Yes Custardy I did read your post and I wasn't aware of that, thank you for the correction :beer: , but it doesn't change the fact that the OP now has all the information they need to resolve this and his latest question has already been answered.

    Sysboy - is this a different Nokia N95 to the one that came with some minutes recorded on it?

    Or is it the one that originally never arrived?

    What happened the very cheap Nokia N73??

    Maybe you should not have sold your original N95 in the first place....

    It's just that I think you should maybe look for other places to buy your phones, as you do not seem to have much luck with eBay judging by the number of posts about different phones and unlocking requests.

    thanks stevew8975, i did met some annoying items which were all not as described, eg obviously old described brand new never used, completely wrong item, but the majority sellers i am buying from are nice sellers.
