    I'm saying that the buyer is free to decide what to do, including call you a liar and refuse any sort of refund. I doubt there are many sellers out there that would treat their buyers so badly, but you have no protection in that situation. If you opt for additional insurance (if it is offered in the listing), you would be entitled to put in a claim through ebay, which may or may not include postage (I don't know - I always use paypal) but does include a £15 fee deducted from your refund.

    I'm sorry buy your are wrong on all accounts as far as my situation is concerned:

    (1) I've made several successful claims from the Royal Mail. My point about having the buyer put non receipt in writing is that it 'certifies' that they are telling the truth.George

    The difference is I believe my buyers if goods don't arrive, having them sign a bit of paper to prove to me they are not lying is not how I work.
    (2) I do take Paypal, and I buy lots of items via Paypal sellers too. I seldom bid on items with special delivery or recorded delivery as p&p is then poor value. These sellers obviously aren't aware that Paypal makes it near-essential to use recorded delivery of some sort. I somehow doubt it, but will re-check.

    Yes there are plenty of sellers that take paypal and yet still claim they don't accept responsibility for lost parcels. Sometimes they post on here asking what to do when they get a chargeback against them and that's the first time they read what they signed up for with paypal.

    If bleugh (I think it is bleugh, apologies bleugh if I have named the wrong person) is around he will post links to the various paypal warning sites. Whilst we don't necessairly agree about paypal the one thing we both agree with is that if you use them you need to know *exactly* where you stand with accepting payments. Your own terms and conditions cannot over ride the paypal ones, and they require a seller to prove delivery of an item if the buyer claims non receipt.

    If you use a cheque then you are relying on the good nature of the seller to refund to some extent. Obviously any decent seller will just refund you within a reasonable time frame anyway, regardless of payment method, but the difference will be if the buyer refuses a refund and denies any responsibility for the lost item.

    If an item is lost and you pay by paypal and do a chargeback you will get back the full amount paid including post and packing. If you pay by cheque and have to go through ebay resolution it will take months, you have to pay a £15 admin fee and you may or may not get the postage paid back.

    Now you see why I only use paypal for payments.

    Well i purchased something 3 weeks ago now and have e-mailed seller and they think it may be lost in the post, they said item is insured though. I emailed him friday and sunday to see what he intends to do and although i know seller been online, as he's left buyers feedback, he has not replied. Do i go straight for a chargeback through paypal or give more time :confused:

    After three weeks and no contact for three days to your enquiry I think I would just go straight for the chargeback. As he is still selling he may well just refund you as soon as the chargeback hits the acocunt, rather than try and struggle on with a blocked paypal account.

    Whatever happens do not stop the chargeback until you either have the item or have the refund, once you stop a chargeback claim it cannot be restarted.

    Some sellers might try and clear any remaining funds from their paypal account and divert new funds to a different payment option to avoid there being a balance on the paypal account with which to pay you back.

    If you just slam in the chargeback he can't touch any funds in his account once the chargeback is lodged.
