Late with rent.

Ok I know I'm late paying rent but is this a little over overzealous...

Housing association. in England.

Rent is due on Mondays £100, I pay anytime up to Friday, I guess with the payment system it can take a couple of extra days before it hits my rent account, so yeah I'm late, this week I get a letter saying I'm 2 weeks late, even tho I paid a week on the Friday, I get a letter on Tuesday saying I'm late by 2 weeks (so 1 week was paid on Friday and the other week was 1 day late by Tuesday) even tho my online rent accounts says 1 week, no mention this is a problem for nearly a year until this week, when my tenancy is due to change from a starter year tenancy to a secured one, might have nothing to do with this but it does seem strange to get a letter again today saying I'm 2 weeks late and unless it's settled within 3 days an order of possession will be filed :eek:

I understand HAs need to keep on top of rent payments but to threaten a court order for 2 weeks rent seems excessive.

    Do you mean that you regularly pay on Fridays for the rent that's due on the following Mondays, or that you always pay it up to 5 days late?
    If the latter and it's been going on for the best part of a year, are you really surprised if the HA has had enough of it?

    The latter. Friday would be the latest I paid, most times it was earlier, even if I paid on Monday it still wouldn't hit my account till maybe Wednesday. The rent doesn't show on my rent account until Monday so they must expect the rent tohit the account later, as it's their payment system that has a delay.
    If this was the issue then tell me before threatening a court order.

    If the letter said an order was being sort for persistent lateness then that's one thing, it said for 2 weeks late rent, surely an order cannot be sort for 2 weeks late rent?

    How do you pay your rent?

    * Cash? Handed over some time during the week (ie late)? Or cash paid on time (Monday), but they don't process it to your rent account till later - in that case, simply show them the receipt you obtained dated Monday.

    * Standing Order set up with your bank? Timed to reach the destination (HA) account when?

    * Direct Debit? Then it is for the HA to set this up with their bank timed to reach them when they want it.

    * Some other method?

    If you are paying the rent, it is up to you to time it so that it arrives on the date it is due (ie no good sending it by Standing Order on Monday as it will be late)

    If they are taking the rent from you (ie by a Direct Debit which you have authorised), then it up to them to take it from your bank when they want it.

    My point is, if my rent account says on Monday I owe £100 and I use their payment method which takes 2-3 days,they can't expect it on Monday.

    as my OP i understand I'm late, the question is can they threaten a court order for at most 2 weeks late, which really works out at 1 week and 1 day late.

    They can. I assume there is a choice of payment methods and this one takes 2-3 days. Even if there is no choice, if the deal is that the payment method takes 2-3 days, you need to make the payment 2-3 days before the due day, so you know that it hits your account on time.

    I have a credit card with a major High Street store, there are a choice of payment methods, some are instant, some take days. I have to make the payments so the money hits their account by the due date or I get penalty payments.

    I can't comment on how their systme works, however I repeat:

    If you are the person instigating the payment, then you are responsible for getting it paid in time. You know when it is due - and if the system used takes 3 days, then pay it 3 days before it is due.

    If rent is late (by a year, or a month, or a week, or a day) then yes they can threaten court action.

    Or take court action.

    They show the rent is due and I goon the 3rd party site and make payment.

    As said I understand I'm late,that will e fixed, even tho it's their system that has a built in delay, so in future, even before they say I owe rent I will have paid it, seems daft tho to have a system as this.

    this was not the reason for the post, getting slight off track as I admit I'm late, as I did start y saying I know I'm late, the question is, if I put it another way, yes anyone can threaten anything they like, as you say even 1 day late they can threaten court action, but surely a court would not entertain such action for 1-2 weeks lateness?

    I assume you have a job.

    If so, how would you feel if your employer paid your wages 8 days late every month for a year? You'd probably consider terminating the relationship - the HA are doing the same.

    When I rented I paid the rent by faster payment on the day it was due. I wouldn't have dreamed of paying it late.

    And yes it's overkill by the HA but I suspect they are well and truly hacked off.
