OK, I won an auction on the 7th April. It's now the 16th and I have yet to receive the item. I gave the seller a little extra time, due to Easter, but decided to finally drop him a message about the item on Saturday morning (as other items I'd since won had arrived by that time). I didn't get a reply from the seller, but saw that he had been on Ebay leaving feedback for others. Last night, I sent him another message. Here's his reply:
Sorry for not replying to your previous message earlier. Your item has not been sent yet as I have been unable to get to a post office due to work. Unlike some ebayers who sell stuff on ebay I have a job that requires me to work during the day time. I appreciate that this does not help you in any way but rest assured your item is wrapped and ready to be sent on Monday.
Other than this, he has made no attempt to contact me since the auction ended. I also find his response to be somewhat sarcastic. I work and also sell on Ebay, yet I find time to get to the Post Office to send my items out. The question is what feedback should I leave him? I've seen from feedback that he has left for others that he can be a bit of a git (he expects others to jump as soon as the auction ends, but doesn't appear to rush when he's the seller). He's charged £3 for postage and packaging, which I don't have a problem with. He hasn't mentioned anything in the auction saying that posting would be delayed.

personally, i'd leave a neutral saying something nice about the item but that it took a week and a half to post so was later in arriving that you'd hoped, even with easter. you may get nasty feedback but you can comment on it.
i think over a week is too long to wait to get an item posted - maybe if he'd sent an apologetic email saying that he was really sorry, work had been ridiculously busy and he would post it as soon as possible, then give the benefit of the doubt. i don't think his email would satisfy me!:happyhear0 -
what did it state in the auction regarding timescales for delivery?0

what did it state in the auction regarding timescales for delivery?
£3.00 United KingdomSeller's Standard Rate
No timescale given. However, you'd expect the item to be posted within 7 days of the auction end. The lack of communication followed by the curt reply to my second message (after ignoring my first message) is what's bothering me. I paid immediately via paypal, by the way. I might start a non-performing seller dispute and paypal chargeback if it's not here by tomorrow. In a rut? Can't get out? Don't know why?

'you'd expect'
never ever assume anything. always best to ask questions before buying rather than wait til the item does not arrive then ask those same questions.
sellers standard rate could mean any of the postal services. additionally, the seller has not specified a delivery time, so in theory can take as long as they want to post your item. you could open a non performing seller dispute if you wanted.
ultimately though, the seller really has not done anything wrong.0 -

I am sorry but I disagree, if the op has paid by paypal then it is a requirment for a seller to post goods within 7 days otherwise they lose their sellers protection. I think that 9 days is taking the michael and obviously the seller doesn't care by looking at his email. Why shouldn't the op 'expect' to receive her goods in a decent time scale or should we all email sellers from now on to ask when they will post their items, a bit unrealistic really?0 -

As far as I am aware, the seller has done something wrong - he's supposed to send the item out within 7 days of the auction end (ebay rules). If the delivery is going to be delayed, he should have put it in his auction. Personally, I don't think it's too much to expect my item to be posted within 7 days, as per ebay rules. He's lost Paypal seller protection now, as he hasn't posted the item out within 7 days of the auction end. Sellers can't take as long as they like when sending out items - hence non-performing seller complaints. In a rut? Can't get out? Don't know why?

I concur.
The seller should have posted a lot sooner. He doesn't deserve a positive imo.
I don't think you need to think he's being sarcastic - his message seemed polite enough to me, but he clearly fails to realise that although selling on ebay is not his main job, he's obliged to meet certain seller expectations, such as posting within a reasonable (or stated) timescale. My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -
I should add that he has a feedback score of 941, with 1100 positives (947 from individuals) and 6 negatives. He has 3.5 stars on dispatch times. He is by no means a new seller or naive seller. In a rut? Can't get out? Don't know why?

it has only been 5 working days since the item was won and today. weekends do not count. nor do bank holidays.
don't expect or assume anything. just be upfront and ask in the first place.0 -
