Can you claim the International ATM Charges

I've been pretty fortunate over the last few years and have very few "penalty" charges to claim back.

I do, however, have a lot of £1.50 charges for drawing money out via a Switch/Maestro/Cirrus card at a cash machine while working abroad.

Does anyone know if this falls into the category of charges I can claim back?

  • I don't think it does as this is the charge for changing the money to the different currency of the country you are in - could be wrong though!

  • Hi everybody, hope youre all succesfully beating the banks! I am just about to attempt to claim the illegal charges removed from my account by the Halifax. So far I have phoned them to complain, to which they responded by offering me 114 pounds as a good will gesture. I have not accepted this and will now be claiming everything. It came to my attention whilst going throught the last 6 years statements the amount of times I have been charged 1.50 for using my debit card abroad. I have just come out of the army after 7 years, the majority of which I was based overseas. Prodominantly in Germany where obviously I tried to get rid of as much of my wage, before I could waste it on savings and investments, by taking it out at an ATM (to take to bars!!) Everytime I did this I was charged.....Is it possible to claim these back as well?
    I would like to send the completed letter requesting the exact amount I expect them to give me back on Tuesday next week, so if anyone knows would you please let me know asa.

    No, you can't claim cash machine charges, this is a bona-fide charge for a service, albeit a b100dy expensive one, however, the law would interpret this simply as you getting a bad bargain...hard luck on your part...freedom of contract and all that. The analogy would be you paying £100 for a chocolate bar - nothing illegal about charging £100 for one, provided someone's willing to pay it.

    The legal basis of attempts to claim back Unauthorised O/D, Cleared Item charges etc is that these charges ostensibly represent a penalty and are therefore unenforceable under the doctrine in Dunlop v New Garage. I hope you see the difference :)

    I wonder if anyone can help reclaim foreign exchange transaction fees?

    From 1998-2001 I lived abroad as a student. I kept a UK bank account and paid for as much as possible by Barclaycard - until one day I noticed on my statement that all foreign transactions incurred a 2.75% transaction fee (I remember reading something at the time that this information was introduced on a mandatory basis).

    I note that in the US a recent class action lawsuit (http://www.travelfinances.com/blog/index.php/category/financial-news/credit-card-conversion-fees/)
    allows people charged fees to reclaim on the basis they weren't properly disclosed (too true!).

    Anyone got any advice on how to approach this over here? :money:

    I hope someone out there can help or has experience in this matter

    I was working in Dublin last year and was charged £1.50 every time I took out funds from my account irrespective of the amount I withdrew €10, €100 etc. The total charges over the time over there was £21.00 - not a lot I know but still a pain in the backside.

    I complainted to HBOS regarding this unfair charge and the cost per transaction withdrawal and received a letter back stating that this charge is stated in the T&C's of my account therefore i knew all about it. basically they refused to offer me my money back.

    Has anyone out there reclaimed for such ATM charges and got a result?

  • I think in the reclaiming bank charges help thread it states you cant claim back charges for atms, you could have a look there.
