    I closed my account with Capital One in 2003 and today have called them on 08009525150. As I no longer have my account number, they are arranging to send me details of this in the post. I spoke with a very helpful member of staff who is sending my out my statements also, free of charge. I asked what the current stance of Capital One is with regard to refunds, he told me they are tending to offer the difference between £20 and £12 for the lifetime of the account.

    Hi All,
    I sent off my letter to Capital One saying i was claiming £968 (inc %)for late payment/overlimit charges ! Received a letter from C one this morning saying they will offer me £280. My card has been cancelled which had a Limit of £400.The charges were due to it spiralling out of control through Lp/Ol Fees which brought the balance up to £880.
    I have been paying a DCA (fredricksson`s) £10 a week and have paid over £600 to them. I wrang Cap One this morning as soon as i received the offer to ask what was going on,they told me I owed £230 on my balance and they would clear that and send me a cheque for £28.
    So do I accept this as a partial payment and go to the next step ? If I accept their offer,the DCA and Cap One win and i get Zilch ! Should i take the £400 balance off the amount claimed and put in for the rest ? Any help would be very gratefull as im a bit confused by all this thanks Stephen.

    same happened to me. my balance is zero, but they say i have an outstanding balance? I have gone to financial ombudsman about them. When i rang them to discuss this the woman i spoke to was terrible. She said that she wasnt wasting time on people like me, and that she was there to help people!

    Well just phoned the number got through straight away and spoke to a guy. Said he would past my request to relevent dept.... althought they wouldn't give me my closed account number even after verifying all my security details! is this normal....

    they said charges will be sent through in 21 days........ fingers crossed!

    You can write and advise you will accept the amount in partial settlement without prejudice (that bit is very important) and will continue to claim for the remainder. Personally I wouldnt settle for less than the full amount, this company are vultures. They may withdraw the offer though in which case claim the full amount at court stage. Good luck :)

    Put your complaint to the Financial Ombudsman in writing enclosing all wirtten correspondence on the matter between you and Capital One. They will need full details to address your complaint.If you havent already done so get them to state clearly in writing exactly what the balance is on the account.

    Yes, due to the data protection act, card companies are not allowed to give out your card number.

    If anyone was tapping the phone line, you passed all security, they could easily use your account! I know you said it was closed but it does happen.

    Just a quick post to encourage you all to keep at it and follow the procedure Martin has outlined, because it really does work!

    We have just received back £200 of charges, interest and £30 court fees from Capital One! They said that they would send us a cheque but they actually credited it to our card.

    (This success has now given us the confidence to claim over £4500 of charges and interest from the Yorkshire Bank...)

    Capital One were very quick to respond to my final letter to them, they haven't increased their offer of £188, the differance from the £20 original charge to there £12.

    I take it I now proceed with Online Court Claim. I need to know the Address for Capital One that I place in for the online Claim?
