  • And so it goes on. We managed to get cancellation numbers via live chat. Phoned Barclays with these numbers as that is what they told us to do yesterday. Without them they could not cancel the transactions!!

This morning they have told us these numbers mean nothing and that they will still honour any requests made by these companies and pay them. We could end up in thousands of pounds worth of debt which the man we spoke to sais well yes but it won't actually ruin your life!!

We have to wait 31 days now for action. If after 31 days money is taken we can lodge a dispute to claim against company. Guess what the man at Barclays said it wasn't a scam

I thought the bank was there to protect your money. We have quite clearly raised their awareness, done everything that they told us yet they still won't stop payments. It is safer to leave what little we have under the matress.

I cant belive a big bank like Barclay and VISA debit fail to protect and support their customers.

    Any ideas anyone?

another one showed up on my visa bill from Elite £15. What I'm paying them for I don't know.
I put a pen from dazzlewhite back in the post box yesterday and just put return to sender on it. which I will do with any future stuff from them.

Elite Pack is the latest of the numerous 'names' to hit my credit card and that too was for £15. From searching the 'Net I believe this payment is for a subscription to which you/we/everyone signed up when requesting the original Trial of whichever product we chose.

My credit card company tells me that all three of the 'names' that have so far claimed money from my account are based in a Cyprus food store.

I'm expecting both Elite Pack and another, yet unknown, 'name' will be taking more 'subscriptions' from my account at the beginning of December. The only upside for me is that I never received the original Trial and, therefore, had no chance of cancelling these alleged subscriptions within 14 days of placing my order. Thus I'm hoping that as no contract existed between Clear Lift and myself, I should not have been 'signed up' with any other company.

I've read so many posts about this organization and all its hundreds of different guises and almost everyone caught in their traps is left feeling foolish. That was my first thought also but I've been using the 'Net since 1990 and have purchased countless items online with no problems at all. It's the unscrupulous who are in the wrong, not those who trust them. I'd like to believe there are many more honest traders in the world than there are scammers.

  • Apparently another company has the trademark rights to dazzlesmile™ and they marketed their product through an affiliate network /ad agency called Epic/Azoogle Ads. Allegedly Jesse Willms was an affiliate of that network and allegedly used fake blogs, spam and other dubious methods to send orders to the original dazzlesmile™.
The promotion for the offer was a similar deceptive free trial offer and lots of complaints followed. So the original dazzlesmile™ eventually ended their contract with the ad agency. Then allegedly Jesse Willms (Just Think Media) set up a shell company in Cyprus called Farend Services Limited and allegedly used the original ads and web content to promote a teeth whitening product also called dazzlesmile™ (and dazzlewhite) sticking labels on the whitening pens which are sourced from China at very low cost per unit.

So now original dazzlesmile™ is suing Jesse Willms/ Just Think Media and the affiliate network and Microsoft and Google!

It's all a bit confusing but this explains it all a bit better:

Or if you want all the sordid details you can read the legal doc in full at:
    http://www.dazzlesmile.com/epicadvertisingcomplaint.pdf

So Jesse Willms is already being taken to court by Oprah over Acaiburn:

Has been taken to court by Microsoft in the past:

And is now being sued by someone else!

    According to Which? "
    Conditions and requirements of chargeback

The main requirement for compensation is evidence that there has been a breach of contract.

If you have any trouble when putting in a claim to your credit or Visa debit card provider, try asking to speak to a supervisor. Chargeback is less well-known than section 75, and some bank staff may not be aware of this rule.
If your card provider rejects your chargeback claim, you can take your case to the Financial Ombudsman Service within six months of your final correspondence.

Ironically though, it seems that (depending on your bank) sometimes people who are dishonest and say that their credit card has been lost or stolen (meaning they are not liable for charges if this is 'reported' immediately?) fare better than those who are honest and tell the bank that they are the victim of a scam!

I know it doesn't make any of us feel better, but this isn't a scam as such. A scam would be something that takes your money and either sends nothing, or sends a fake product or one of inferior quality. We all fell into what is a deliberate trap - a deceptive web page, bogus plaudits and endorsements and a failure to read their T&Cs. I don't think any of us should feel foolish, it has caught so many, many people and we can't all be thick! I personally feel furious, largely because I can't get at the scumbags because of the distance.

I think if all of us tried to find a way to make life hell for these people, and I personally also have the dream that some hacker can repay all their ill gotten gains, or better still, some software cleverclogs that could write over all their webpages just exactly what the catch is, we might have some effect. The link to the federal complaints page is a good place to start I think. I did try last night but I managed to make the page freeze trying to get into dazzlesmiles T&Cs for the return address!

My bank did say that the companies change their name all the time, again, another ploy to try to confuse the issue. I bet they all race out of the same stable. Cyprus is nearer, perhaps we should get together and mount an assault on Farend products.

It is a scam they take your card details and cleverly syphon money. You don't know how to cancel until a transaction pops up on your statement and even then you don't know who to contact.

We never received a trial tooth whitener or any of the other so called products. Part of me feels afraid to make contact in case it initiates a further withdrawel.

Yes we are all gullable but if it is all above board and not a scam why can't we just cancel.
  • I contacted Rackspace and politey informed them about the dazzle sites and 24hrs later
nothing. So maybe it needs everyone to post them a little message.? who knows, having said that Facebook Google and other trusted sites dont appear to mind letting them advertise, it brings in revenue, i dont know i am very disapointed in mankind seriously who can you trust

Did you contact the UK or the US? Just that it was thanksgiving in the US yesterday so that may be a reason for no reply yet......... ?

I will send them an email too and include a link to this thread and any others I can find - they can ignore 1 or 2 complaints but when they see that there are thousands online maybe they will do something (worth a try anyway)....

Is Cyprus warm at this time of year?;)

Is it a scam when a contract is void owing to non-receipt of goods, a cancellation number is given but despite this 'affiliates' continue to withdraw funds? It's seems sharp practice at the very least. As to the Terms and Conditions of the company with whom I dealt, they are no more as the advertisement/web page I used no longer exists. Yet another dubious product seems to have replaced the one I never received.

    Many thanks competitionscafe: most helpful.
