Hi. I sent first letter to Bank of Scotland for list of charges. They sent me a letter saying dealing with the claim and I would hear from them - this came before my statements, which I was told meant that I was already on the system and that I would not need to list my charges as they would have a list of them and take it from there.

I received one years statements amounting to around £400 in charges, SHould I wait for the rest or put this in as a part request? Or should I call them and find out why?

Also did anybody else get an offer based on them sending you a list before you issued them with a list for the money back?

    Thanks.
  • hi
I applied to Bank of Scotland for my charges data and they have only sent back 2 years worth because they are sooo busy. Any idea whether you can claim for the last two years and then claim again when they send through the remaining details as they did not give an clue as to when the other data would be sent to me

    any help greatly appreciated.

I'm also about to start the process with BoS. Bit confused about the differences in the English/ Scottish systems (I'm in Scotland), so would be grateful if anyone could clarify things for me.

It appears I can claim for 5 years of charges through the courts, but can I claim 6 years worth through the initial process? Do I send the tenner in with the first letter, here as well? And basically, does geography affect my chances of success!

Thanks to anyone who can give me some pointers, and congrats to those who have succeeded :T

    Hi

I believe you would need to raise an "ordinary cause" at your local sheriff court. you can check this out on https://www.scotcourts.gov.uk. Hope this helps.

Thanks very much i will reclaim this asap :A

    Hi 75 scruffy,
You can also go through the Financial Ombudsman Services. Their service is free of charge, but you need to write to bank to request a refund first and allow them 8 weeks to give you a satisfactory reply. after that, you hand your case over to the FOS

thanks very much for your help it's very useful info :A

i telephoned them asking them to reconsider and a week later got a letter saying that the charges were valid but as a good will gesture they will pay me £404 into my account which is less than half they owe me..... should i take it or go for the full amount?

So did you ring them after 7 days even though they said 8 weeks?

Well done for getting your money back!

I rang them 14 days ago and they gave me the standard 8 week wait, should I ring sooner or just sit it out?
Hi I actually had waited 8 weeks already so I rang and just explained that I started this claim way back and the man was really helpful. You sometimes need to let them know that you know a little more about this process than they think you do. Good luck.

P.S. still waiting for my cheques mind!!!!!!

Hi if I were you I would wait! They tried to fob my brother off by assuming he wouldn't check the charges for himself, and told him he only had 5 charges when in fact they had taken nearly £1000 in charges from him in the last 6 years.
Ring for your other statements and go through them yourself, you will be sure then.

Ring them and negotiate. they really dont expect many people to accept the silly first offer anyway. Just stick to your guns!!!

    good luck
