    Your point being?

(Bearing in mind that my post was intended to correct the misinformation you posted regarding what would be claimed from the defendant.)

    Which misinformation?

In any event, I've realised this wouldn't even go to Small Claims Court because there's no disagreement over moneys owed - we're sitting in Quentin and MJ's Court Of Cheques That Take 28 Days to Arrive at this point.
But on the subject you now raise, you expect us to comply with your conditions and get our claims in on time, so why expect us to wait anything more than a day for our money?

This comes down to 1 concept; "reasonable", that cornerstone of consumer law. It's reasonable to allow 30 days for a customer to copy their bill and post/email it to us. It's reasonable that it takes up to 28 days (currently 4-7) days for us to validate this claim and confirm payment. It's reasonable that it takes CPW up to 28 days to request etc and send the cheque. Only yourself and MJ have issue with this, and only one of you is a customer of ours, so I think this is the end of our discussion on this point.

    Thanks,

Couldn't beleive what I was reading and almost spat my cup of tea all over the screen

That's disappointing - I gave the solution to Returns on Thursday. I shall chase it up for you now - obviously I don't (can't) run the whole company myself. Rest assured that the cancellation is done and compensation for the hassle will be on its way.

Please allow up to 28 days for delivery.

I am sure it's not "only" us two who take exception - merely because we are actually try to pin you down on it. It still comes back to you not acepting your own t&c. Is it "reasonable" to ignore them as far as payment times are concerned yet enforce them rigorously when a claim is (debatably) ONE DAY late??? VERY reasonable indeed!!

My suggestion is actually VERY simple. Acknowledge that t&c ARE just that and actually comply with them - jsut as you demand customers do! If you won't comply with the timescale then change the timescale - but NOT for existing contracts. What is so difficult if you are such a "fair" company"?

I assume you've only helped 149 now - or does it count when (as always it seems) things are out of your ("senior manager") control??

Perhaps you are now starting to get an understanding of what I and others have been going through ;)

I think I've been upfront about the fact that the Returns Department are struggling right now, so I've been doing my best to support them both on here and internally. I understand completely, I wouldn't want it to happen to me, and I can only apologise and work to fix things.

Cheques currently take up to 28 days to arrive after we request them from CPW's secure printer. I was saying it before someone else did.

The misinformation where you suggested that losing a court case would cost your company just 56pence of "commercial" interest!

You mislead when you talk about allowing us 30 days to submit claims.

You get 30 days to post our cheques, but we don't get 30 days to submit claims!

And as you know, Ofcom don't think anything less than 60 days to get claims in is (in their word) "restrictive". Customers might say "unfair"!

Length of time for payment to be received wasn't on the cashback page until I amended it last week, so we've gone from no obligation to a realistic one where delivery of payment is concerned.

The page previously only talked about the timescale for confirming and sending the rebate, which we are well within as you yourself have demonstrated (21 days).

Everything after this point is logistics, and not the basis of an agreement with the customer.

Really, really my final contribution to the cheque-raising debate.

You're right, I was wrong - as I pointed out above there's not even a case to answer as SCC deal with disputed moneys owed, not payment terms in this context.

As previously stated, we're changing this very very shortly. I honestly believe that 30 days (and it is 30 days; bill date + 30 days) is enough time to stick something in the post.

As previously posted when you made that assertion regarding the courts, many of us have successfully sued CPW companies (some going all the way to getting CCJ) following late arrival of the money owed.

You do not allow the 30 days you claim.

    1) It is 30 days from the date on the bill (irrespective of how long that bill takes to be delivered to us!). You of course get 30 "real days" to send us our money.

    2) By your own admission, you expect that should the 30 days end on a Sunday, you then want reject the claim unless it arrived by the 28th day!
