I'm not trying to be awkward Rtype but you need to decide what speed you were really doing. In post 36 you "believe" you were doing 30mph max then later in post 47 that's gone up to a max of 35mph but "reckon" it was 33mph.
So on this basis how do you know you weren't travelling at a higher speed? Without having your eyes permanently on the speedo or rev counter(if fitted) it is very easy for the speed to creep up with very little effort.

I originally said i was doing 30max as there were lots of people posting unhelpfull comments basically saying you were speeding end of and how they were fed up with people moaning about getting caught etc.. when all i wanted was a bit of advice rather than a slagging off.

I was doing around 33 when i looked at my speedo, there is absolutely no way that i was or could have been doing 50 or anywhere near it.
    Nice to save.

The 30 limit means 30 is an absolute maximum. Not a speed which you can exceed a little bit if you want.

If you have difficulty reading the speedo why not travel a little bit slower? I am sure the few seconds extra it will take to do 28-29 instead of 33-35 will not reach the amount of time you have spent worrying about this...

If the OP's speedo was reading 33 it's likely he was actually doing 30.

And in any case aren't speed cameras calibrated at 10%+1mph, so if it's a 30 camera it shouldn't flash you unless you're doing 34?

This is exaxctly the kind of pathetic post i was referring to!
I am not arguing that i was speeding, i am arguing the fact that they are saying that i was doing 50 which is just a complete lie!

It was not a speed camera but a laser gun being operated by a policeman hiding round a corner in the pitch black, wearing the incorrect ppe so that he could not be seen!

I am looking for advice for the fact that a policeman (or possibly psco) is lying which is a complete abuse of his position and he should not be allowed to get away with this!
    Nice to save.

UPDATE: This one was up in Court today, and I went along to help the OP with his defence.

He, and his girlfriend, had made statements contradicting the officer's version of events, and we were hoping that, as upright citizens, the word of two against a single civilian officer, with no physical evidence, would win the day.

As it turned out, we didn't need to go that far, because the (very) junior prosecutor from the CPS concluded her case without producing any evidence of the identity of the driver.

We pointed this out to the court, and after a brief discussion, the Clerk advised the Mags that they should dismiss the case, which they did, and costs were awarded to the defendant.

So justice was done, and the civilian officer was in court all morning instead of zapping more drivers with dodgy evidence - a great result!

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

I take it this is the excellent result I've just read about on another site?

    Well done.

Dont bother challenging it,just pay up. Fact is..either you were wrong or he was wrong. The Police cannot be wrong otherwise, where does that leave us?

With a corrupt police force who think they have the right to do whatever they want, thats where!

Thanks to Bargepole who was great, if there weren't people like him with the knowledge to help others in these situations then the police (or part time police) would be given free rain to impose anything they wanted!!

Its good to see that these things can be challenged and won (despite the CPS making it extremely difficult), and also that the police force is still full of corruption!

Thanks again to Bargepole, good result mate!
