Hello.. Great work you lot are doing I must say.
It's annoying that private companies obtain money just by threats.
Iv done a lot of research today and I already lnew some of this previously.
Anyway.. I'm in a sticky situation and really really need help.
Me and my girlfriend moved into a new flat on the 1st July 2015.
There's a small car park area in the front and generic signs belonging to JD Parking consultants LTD, threatening £100 fine reduced to £60 etc.
We parked there for convenience of moving our stuff in and we kinda just kept parking there anyway as we never recieved a ticket nor saw any parking attendant. Some may say that's foolish but we rent this flat and we would like to park right outside lol.
My girlfriend who drives the car recieved a txt from her dad today (RK) saying he's recieved 6 parking fines in total. 3 of which were dated on the 6th of July - 3 in one day !!!!!!?
They live down south and we live in Leeds (headingley) so I haven't got pictures of the NTK yet.
A few facts -
He hasn't recieved anything from before the 6th yet we've parked here from the 1st onwards.
our tenancy agreement which we've obviously signed reads: 'Parking vehicles on the premises is not included in your rent. If there are parking areas, these are rented seperatley. Please ask a member of staff for availability and costs.'
There are maintainance men here every few days carrying out different bits of maintainance in people's flats or in the main building - they work directly for the letting agent. Their vans are plastered with the letting company.
So my questions are, if you would be so kind as to help:
Are we at fault for repeatedly parking day and night and ignoring blatant signage
If there was no PCN ever issued on the windscreen at any point has there been an attendant coming around without us noticing? Taking photos? Could it be the maintanance men? Could it be an ANPR camera hidden near the parking spot?
If it is a camera why only from the 6th onwards?
Finally could someone link me to the appropriate template for this scenario or help me re word one. I know that sounds lazy but I need to try sort this quickly and convince her dad that we can appeal it successfully so then he's not angry with us (because other wise he will think he has no choice but to pay it) I also work quite a lot and I'm a father and I have my daughter 3 times a week. I need to sort this ASAP iv put my research in but now I want some actual help from you lot! :A

It is not a fine, it is a speculative invoice.
Use the template in the aforementioned NEWBIES thread to appeal. Use it exactly as it is.
One appeal for each NTK.
Either your girlfriend's dad will have to appeal these as RK, or you or your girlfriend can do it on his behalf as if you/she is het dad.
Do NOT reveal who was driving. Never 'phone a PPC.
Most of what you have said is irrelevant as far as the appeal is concerned that's why you should use the well tried template without amending it in any way.
It sounds like you need to sort out renting a parking space or find somewhere else to park.
The PPC is a BPA member so the idea is to make the initial appeals to snag a PoPLA code then make a second stage appeal to PoPLA it where you should win if you follow the advice on here. Sorry about wanting a reply so quick.. Desperate times n all that.
So I used the template to email/post to the ppc.
Then they refuse my appeal and will send me a POPLA code.
Can I then come back on here for help with my POPLA appeal!?
If you guys were as greedy as certain LTD companies you could charge for doing this for me!!
And listen.. When I say thank you I genuinely mean it. I knew previously about PPC/PCN having no legal standing but you guys are here with all the exact info.
We moved the car to the street to behind the flats. Will call the letting company today to ask if it's possible to buy a permit for our flat. I won't even mention who I am I just want to ask that question.
Does anyone have an idea who's dishing the tickets out? A camera in the grounds of someone working for them taking pictures?

appeal each ticket separately , get 6 or whatever separate POPLa codes , this will cost the %uggers 6 x £27 , after the first couple , they might just "twig" and cancel the rest.
DO NOT appeal the lot in one letter , or one envelope
EDIT: JD are not registered for ANPR , and you say no tickets were placed on the car?
can you look around the signage to see if it clearly states ANPR or uses the camera logo?
confirm the date of the first ticket , and the date received ?0 -
Is her dad the RK or just a concerned father who would pay his daughter's PCNs?
If He is the RK, then any appeals would need to be in his name (eventually). He could name your daughter as the keeper at the time but she may, of course, not been the driver on these instances so she could appeal in due course admit to being the kkeper but not admit who was driving.
Your appeal will probably be centred on signage and possibly no contract but as you were parking on land that you could have bought a parking permit for, it is more akin to going to a P&D car park and not buying a ticket rather than overstaying or parking somewhere that you would never have been able to park in under any circumstances.0 -
JD Parking Consultants is a pathetic tin-pot ex-clampit run by former probation officer(!), nightclub bouncer and convicted criminal Joe Grinion. In November 2013 he was convicted in Leeds Magistrates Court of offences under the Security Industry Act.
You may wonder why a company run by a criminal is permitted to join the British Parking Association and obtain vehicle keeper details from DVLA. This is a question you should put first to the BPA and DVLA, and then when they give you the brush-off, your MP.
You may also want to draw the attention of the management company for the flats to the reality of Grinion's murky past.

looks like this lot have failed to meet POFa 2012 , by sending NTK earlier than 29-56 days , UNLESS it can be shown that they have clear signage showing ANPR in force.
because of this , its not down to the owner , just the driver , who you do not need to disclose .
this lot use PCS/DR+ as there method of collection http://jdparking.co.uk/received-pcn/ http://www.parkingcsl.co.uk/ and will advise you to appeal via them , the appeal is biased , as in they are debt collectors! , if you do appeal , expect a reply back , not from JD , but a reply from PCS/DR+ , as JD have never seen your appeal!!!

Think you may be wrong, Freddy. No PCNs on car so PPC has to contact RK within 14 days. 29-56 applies where windscreen tickets have been issued.

yup , in less than 14 days IF ANPR IS USED , in this case JD parking do not seen to have been accredited and approved and the systems (there are non) audited to see if they are compliant , therefor they are not allowed to use the "cloak" of the BPA and use POPLa 2012
there are only two legal methods of issuing tickets
1: anpr < 14 days to receive NTK
2: ticket on car 29-56 day to receive NTK
JD are not allowed to use "plan 3" , and an interesting thought , the OP states 3 tickets in one day ??? OP did you move your car 3 times on that date , did you drive past a fictional camera 3 times?
ANPR is normally used (as you know) for "timed" parking , the situation here is not "timed" , but just parking without a permit.
JD parking have NO ANPR equipment , might have a bloke on a pushbike with a camera , BUT unless the equipment is approved , accredited and checked out by the BPA its useless as evidence
OP , please check for clear signage (or not) stating that JD are using ANPR in the area , in fact get some piccis of their signs.0
