...........It,s email to the court is not a recognisable "answer" to the notice of service - not an admission - and since no direct offer has been addressed to me, is not due process. Further, they have lettered the court apparently saying the claim is settled without any direct contact with me (only told on phone - no sight ) - well no !

Glad we were correct on this one, I was beginning to wonder, what the legal system had come to, if a case could be dropped just on the defendants say so....

So the next thing to expect is form N180 followed by Judges directions.

    Cheers,

You will only fill in N180 if they put in a defence but it's a tick box exercise nothing to worry about. http://hmctsformfinder.justice.gov.uk/courtfinder/forms/n180-eng.pdf

Not sure if I should thank you for that bit of uplifting news !
What I really need is a credible defence to the CC Act interest denial

Oh Dear Thomson! I sent off my claim letter at the start of March and received no response. As the template said I expected a response within 14 days I sent them a lovely follow up letter at the start of April (basically the same letter but highlighting it was the second copy as they hadn't responded). Still no response as yet.

Today I have spent over 2 hours listening to Queen (the instrumental) "Bohemian Rhapodosy" and no one seems to be answering the queue that I am in. I'm advised my call is important, but Im not getting anywhere.

Do I stick with trying to call them to get an answer or should I just send them a Notice Before Action letter? I was sort of hoping a nice phonecall to them would save me a lot of hassle and get a response from them straight away rather than having to send the legal action letters.

Think your being a little optimistic if you think they will respond that soon, most people had no response until about 60 days, it may be a little less than that now as they have probably caught upon the back log, keep phoning them at least then you will know you are on the system.:j

They said they couldn't find me because I was flight only. I have sent them an email copy of it now. I am looking forward to the excuses I get from them however, I shall remain optimitic that they will be at the fore front of customer service and reply within a reasonable time frame and pay me in full straight away.

Glass half full and all that business.
  • They haven't got back to me in full about a delay in December last year. Our flight was delayed for 3 separate reasons, I wrote to them as soon as we got back, they said the reason for the delay was bird strike (which the first delay was) but didn't explain what the technical failure for the plane being flown down from Manchester, which further delayed us, was nor that the crew being out of hours, which again further delayed us when I believe the plane was ready for us, was not an exceptional circumstance ...

My 2nd letter asking for answers to the above (which they haven't responded to) was on 19 February ...

I always call them at 9am - the longest they've kept me on hold is 20 minutes.

There is no need for you to hold on the phone indefinitely or write endless letters. Just one initial letter, ideally one further letter, say 14 days after the first one, and then a notice before action 14 days later. If you still get nowhere, sue them.

You don't have to wait weeks while they "investigate". They know perfectly well which flights were delayed, why and who was on them

Some may doubt the need for the second letter but I advise it just in case you are accused of issuing proceedings prematurely.

    It's all in Vauban's guide

    Thanks Legal Magpie.
I am now sending them a letter for notice before action. In my opinion they have plenty of time. I only called Friday in case they were dealing with my query.

    Wish me luck.

Aplogies, my PC is blocking me downloading the PDF of Vauban's guide to get the text for the NBA letter. Would anyone be so kind as to copy and paste the wording into a comment for me so that I can get it from here? Sorry to be a pain my PC seems to have a lot of restrictions on it.
