Has anyone used the fact that PE break their contract to you? By using ANPR they are NOT providing you with 3 hours parking but only 3 hours on site, therefore their contract terms are not valid. They make an OFFER of 3 hours parking, You accept 3 HOURS but are penalised if you take up the 3hours.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

Just wondering if you could help.
I got a parking ticket on the 4th August, I appealed on the 5th.
They replied rejecting my appeal on the 12th October, I had completely forgot about it. I rang to speak to them mentioning the 56 days and the lady said they have 6 months to deal with my appeal, and then 56 days to deal with a formal representation after notice to owner, is this correct?0 -

Success with private parking appeal :-)
I had parked in Castle Car Park in Windsor in August, and had paid my pay and display ticket but put it on my dashboard instead of sticking it to the windscreen. It slipped and so the time on it was not visible from the outside.
I found a "PCN" stuck to my car from paymypcn
Having read the hints on this website I appealed using e-mail, as their online page (tiny text for the appeals link!) asked for too many details in my opinion.
I didn't give my home address or full name (they could look them up with the DVLA if they wanted to, but I didn't want to make things any easier for them!)
My appeal was on the grounds that although I had allegedly breached the contract by paying, but not displaying properly, I understood that for breach of contract I could only be liable for any loss they suffered due to the alleged breach. And as I had paid for the ticket (I scanned and sent them a picture) I thought that they hadn't suffered any loss of revenue.
I told them that I thought that the £100 charge that they were requesting that I pay appeared to be punitive and did not appear to be a genuine pre-estimate of loss.
Anyway I received a letter from them this week confirming that my appeal had accepted and the "PCN" has been closed. :-)

Following my second charge notice reminder for a parking overstay on MOTO services, M6, Hilton in October 2013. I ignored the first one and then decided to write direct to MOTO via this email: moto@appealpcn.co.uk, using a template appeal letter that I found on here. The only fact i disputed was 'The fee is disproportionate'.
Within 10 minutes of sending the email I received a reply from: ANPRappeals@cp-plus.co.uk:
"Dear Sir,
Thank you for your correspondence concerning your Parking Charge Notice.
As a gesture of goodwill, on this occasion only, we can confirm this Notice has been cancelled in full and no further action will take place.
Please note that all future PCNs will be upheld in full.
Yours faithfully,

On 25 Feb 2013 I parked over the 20 minute free time at Lincoln County Hospital. Car ticketed and complained to landowner who referred me to TPS. Did not reply & waited for letter.
Used your template to deny any loss /damage. Had many follow letters and then one from Zenith Collections (owned by debt recovery plus).
Replied Denying debt saying please return to TPS and if I receive further letters from you I would report to Trading standards as harassment. I received a 2nd letter.
Referred to Financial Ombudsman who was very helpful.
RESULT! Received letter (from Debt Recovery Plus) dated 15th November 13 saying in furtherance to a recent letter received from the Financial Ombudsman Service regarding the PCN I have cancelled on this occasion.:T Thank You very much will pass this advice and experience on.0 -

thought I'd share here, I have won an appeal against a ticket by 'parking eye' on an aldi car partk - I had gone 57 minutes over the allowed hr.
I argued that they would find it difficult to justify any losses occurred by the owner (ALDI) in Court as this car park is 1/3 empty even in busy times. (Obviously this applies also (possibly) if car park is full and you park outside marked bay without obstruction ;-)
note also that parking eye were dragging the matter out by not sending a complaint response which is needed to turn to POPLA. I had to put my foot down by turning to BPA to get them to send that in the first place. They had already put up charges to 70£.
Interesting is that the decision maker at POPLA not only follows my argument of losses not proven, but also says their business model did not convince (they had claimed their expenses for putting up the boards and sending reminders as part of the losses which does not make sense at all).
So be of good cheer and don't pay them.:rotfl:0
