MSE News: Flight delay compensation floodgates open

    I've just double checked the details of our delayed flight back in 2010. It was with Monarch and a return journey from Tenerife to Gatwick. The site confirms it was delayed for 464mins. It doesn't give a reason. I remember the flight so clearly as it was the first time I had taken my sons abroad, they were 2 & 5 at the time. I'd taken my brother to help me through the airport with them and he enjoyed the holiday so you can imagine the joy of that delay! :eek:

    What do I need to do? Do I send the standard letter to Monarch? I don't have any proof that I was on the flight? Is this going to make it hard to claim?

    Was there someone else you had in mind to send the initial claim letter to? ;)

    If you have a booking reference number then you have a claim. (proof of being on the flight)

    It'll be hard to claim as Monarch aren't playing ball with anyone as of yet. But you need to start the claim anyway.

    You might be best off putting any further replies on the new Monarch thread.

    This is so frustrating!
    I was delayed several times with Globespan (as did thousands people I think!)
    Once was more than 12 hours from Boston to Glasgow. This was just after they lost their etops licence; they had to stop twice!
    It seems text-book for this compensation - and I would have loved it, since they never paid any attention to my letters
    But the don't exist anymore :mad:

    They probably dont exist anymore due to the amount they had to pay in compensation, extra resource to deal with the flight delay complaint/claims they had from those thousand people. Just a thought....;)

  • Was delayed for 11 hours with Thomas Cook on a flight from Tenerife to Glasgow in October 2012. I wrote complaining of the delay and asked for the reason of the delay. They have blanked the request for the reason but sent me a £200 voucher to use. I have since found out that the incoming plane from Manchester to Tenerife was delayed due to smoke in the cabin and diverted to Dublin. They then sent two planes to replace the 767 that was due to collect us.
    Is my next course of action sending them the CAA template letter? Any help appreciated
  • Which of the 2 replacement flights were you on? The one that left first or second. If the second, then you were denied boarding and your claim is probably somewhat easier to pursue as there are no real defences to paying up under denied boarding but a little trickier to pursue for delay compensation.
    We ended up on the first one although it was chaos up until it actually boarded as no one knew what was happening and the lack of information was terrible. Thomas Cook staff nowhere to be seen.

    Hi I eventually got a letter from them asking me to complete a form. If you private msg me ur email I will forward it to you. Ive put a claim in with them for a 4+hr delay, due to a serious technical fault. Will let u know if successful.

    I have a question. I flew with Wizz air W6 2206 flight from London Luton to Budapest on 30 November. I had a delay of 4 hours 10 min. I wrote them for a 250 euro compensation.
    First they replied that they I was only entitled to a compensation if my flight got canceled, but they did offer my 30 euro worth of credit.
    I wrote them that that is not true and that also for delayed flights you are entitled to compensation.
    Then they wrote me again that they do not have to pay because the delay was caused by extraordinary circumstance, namely a "unpredictable and extraordinary technical maintenance service of the aircraft", later they specified that the service was needed because engine #2 was leaking fuel.

    Is this valid reason for not paying the compensation? Or should I continue claiming the 250 euro[FONT=Verdana,sans-serif]?

    Dear all

    Thomson have agreed to settle out of court for the full amount (400 euros x 2 + court costs of £140). I was due to go to court this Thursday and it had been put on hold for 2 years and I started it up again before Xmas. They could not prove that the 16 hrs and 33 mins delay was caused by extraordindary circumstances and in fact that our plane was used to pick up passengers in Mexico due to a technical difficulty in Mexico. My ex-husband is a Barrister and helped to write the claim against them which I am happy to post on here or send to others.

    Victory! Just to say - do not give up - They wrote a 12 page defence originally but it was all rubbish.
