Mum been hit from behind, what to do now?

    Your Mum was hit from behind, it's automatically the other drivers fault. It'll only be a matter of time before the other party's insurance admit liability.


    It is not automatic, there are plenty of times were it is the front driver at fault, i.e when changing lanes when not safe to do so, or would you say if I had not managed to stop an accident HERE that it would have been my fault if the stupid Audi driver was hit in the rear?
    He was totally at fault, there was no need to change lanes then brake.

    Still your fault if you hit him up the chuff. Who are you to decide if he needs to brake or not?

    From that video looks like there were two prats and only one in the Audi.

    I did not say anything to the contrary, I was pointing out that it is not automatic to be at fault by hitting someone in the rear

    I was in the outside lane approaching the slower car in the inside lane, when the Audi driver decided,(without reason as there was nothing behind me nor was he that close to the van in front of him), to brake and pull out, that is at least inconsiderate driving and/or without due care and attention, he woiuld certainly have been pulled if he pulled out in front of a po9lice vehicle.

    Why would you imply I am a prat? I stopped an accident by being observant and slowing enough to avoid an accident caused by the Audi driver!

    167DO NOT overtake where you might come into conflict with other road users. For example
    • approaching or at a road junction on either side of the road
    • where the road narrows
    • when approaching a school crossing patrol
    • between the kerb and a bus or tram when it is at a stop
    • where traffic is queuing at junctions or road works
    • when you would force another road user to swerve or slow down
    • at a level crossing
    • when a road user is indicating right, even if you believe the signal should have been cancelled. Do not take a risk; wait for the signal to be cancelled
    • stay behind if you are following a cyclist approaching a roundabout or junction, and you intend to turn left
    • when a tram is standing at a kerbside tram stop and there is no clearly marked passing lane for other traffic

    Being overtaken. If a driver is trying to overtake you, maintain a steady course and speed, slowing down if necessary to let the vehicle pass. Never obstruct drivers who wish to pass. Speeding up or driving unpredictably while someone is overtaking you is dangerous. Drop back to maintain a two-second gap if someone overtakes and pulls into the gap in front of you.

    You left it late to pull out, you were far too close to the Audi driver as you pulled out, had you have pulled out sooner in to the right lane, he may well have seen you sooner.

    You could have easily dropped back as soon as you realised what was happening, instead of blasting away at him.

    If you hit someone in the rear it is automatically your fault.

    Inactive is correct in what he says.

    Your video is completely irrelevant to the OP's situation anyway.
