Interestingly, the chap I spoke to mentioned "section 75" and "blood out of a stone" in the same breath....
It's all making me wonder whether I gave up too easily on a claim about a year ago. My fault, I thought, for buying with a credit card via PayPal. PayPal said there's nothing they can do, and MBNA said it's all on PayPal.0 -
Hi - was your card a visa with Barclays bank. Mine is with the Halifaz and I am anxious to hear from anyone who has a refund on the DEBIT card. thanks for your posring Brijac(Brian)
I have today received a full refund on my Halifax visa debit card. It took about a month for them to process it. I spoke to them via the customer services department and it was passed to the non-fraudulant department, who were meant to write to me to confirm they were dealing with it - never got the letter but as I got the money back I don't mind.

Further to my earlier post on this thread, #28:
Today I received a 'phone call from my card issuer saying that they will be writing to me with a "full and final settlement" offer of the difference between the amount originally on my card (already recovered) and the fare I had to pay to get two equivalent tickets on BA.
Almost £1000 !
So, for the cost of my two Maxjet tickets, we are now flying to LA Club Class on BA.
Well done Section 75 of the CCA !!!!

Finally got my refund back from my CC for 2 tickets I booked on Maxjet in June 08.
As soon as Maxjet went bust on the 24th Dec I rebooked flights with Virgin Premium Economy for the same dates. The cost differnece for the 2 tickets was about £700 pounds more than the Maxjet. Should my CC have repaid the difference between the 2 purchases as well as the Maxjet refund ??? If they should have how do I approach them again. Many Thanks ( Im glad to have got the Maxjet money back as I know some people are still struggling :mad: )

You are most certainly entitled to more than just the fare you paid to Maxjet.
Your contract with Maxjet (and your CC company) was for "business class tickets to ??".
As Maxjet have gone bust, your CC company has to make good that breach of contract. If you paid £700 extra for your Virgin tickets, claim that back.
I paid nearly £1100 for my Maxjet tickets, then had to pay another £900 for Club Class on BA when Maxjet folded.
My CC company have already refunded the £1100 to my card account and are sending me a cheque for the £900.
Write to your CC company and send them details of your original booking, dates, time, costs, etc AND the same details of the replacement flights you have booked.
Don't be fobbed of by requests for things like any "bonding" Maxjet had with ABTA, IATA, ATOL etc , etc - that is totally irrelevant0 -
When I heard the news about Maxjet filing for backruptcy I rebooked straight away with Virgin, Same dates, Same Destination ( Las Vegas ):j but because of having just paid out in full for the Maxjet Tickets in November on my CC. I rebooked premium economy with Virgin, I couldn't afford to travel business class with Virgin after paying out for Maxjet tickets ( Not knowing if I would get a refund ). I rebooked using the same credit card. My first letter that I wrote to my cc company I asked them for the refund for the Maxjet tickets and the difference in having to pay the extra £700 pounds for a lower class seat on a virgin flight.
The cc company were a nightmare to deal with from day one just to get the Maxjet refund. Every time I spoke to them they told me a letter was in the post and I would have to wait 10 days. All I recieved was junk mail from them:mad: . After many phone calls and one particular rude lady. I managed to speak to the Senior Bank Officer in the Chargeback and Disputes Department. A month after sending my original letter, emails to and from Maxjet and all corresondance I was told that they had not even looked at my claim.:mad: Within about 2 days of dealing with the Senior Bank Officer I was issued my refund for the Maxjet Tickets. I enquired about retrieving the difference in ticket price between Maxjet and Virgin and was told that they do not do that, they only refund the original ticket price. I am of course glad to get my Maxjet money back
. After having a month of ripping my hair out and :eek: and Im sure going a little greyer should I be quoting for instance Section 75 :rolleyes: or similar to the cc company to get this additional money back. Any help to make this less painful would be appreciated. Many Thanks

I will PM you the "guts" of my initial letter, re-hash it to suit your particular circumstances.
The things to remember are:
1. Your claim is not limited to the amount on the credit card (Financial Ombudsman's web site says that)
2. The CC company HAS to put you in the same position you would have been in had Maxjet not gone bust. ie: business class tickets to Las Vegas, or what ever you consider to be equivalent - premium economy is certainly OK.
That is the LAW, (of the Land), not as one idiot from the card issuer said to me on the 'phone "Mastercard is my Law !"
Also, perhaps it may be worth reminding your CC company that the Financial Ombudsman has, in the past, made card issuers pay compensation to card holders that have been "messed about".
If you get too much 'aggro' from them, threaten them with a County Court summons, they will pay up !0 -
I don't suppose anyone paid for their flights with a Cahoot credit card ?
We first contacted them on the same day as the announcement (Christmas Eve). We had a couple of replies to emails we sent over the next few days but then it took them the best part of a month to send out the forms we needed to fill in. We sent our dispute form to them over a month ago and all they have done is mark the £1400 transaction as a disputed payment (ie it doesn't incur interest charges) but so far haven't returned the money. When we asked how long it would take resolve they told us, via email, that it could take up to 6 MONTHS !!!!
The last email we got from them (on the 19th Jan) says:Thank you for contacting cahoot in Coventry.
We have received your signed dispute letter and the investigation is under way. We will write to the Merchant's bank who then write to their customer. The company then has to prove the reason for debiting your account. The company are given a month to reply to there bank.
This process can take up to six months although this is unusual. We do not need the email from the company.
If you require any further assistance please do not hesitate to contact us again.
We have already sent them all the documentation we have - we bought the tickets direct from Maxjet - receipts, emails from Maxjet announcing their bankruptcy, etc, etc but Cahoot still insist on writing to their bank !!??!!
We offered to send them a copy of the email from Maxjet, we received, about "Notification of service non-delivery" which basics states Maxjet have no intention of providing the service we paid for but ... Cahoot said they didn't need it ?

They are just ****ing you about !
1.Remind them they have a legal duty to repay you.
2.Remind them that the Financial Ombudsman has made card issuers pay compensation to card holders where they have deliberately delayed refunds.
3.County Court !
All they need is proof that you bought the tickets - which they have: and proof that Maxjet has gone bust - which they also have . If you are claiming for the extra costs for flying with another airline, you will need to supply them with invoices for the new flights showing costs and dates/times.
My card issuer tried to get me to provide all sorts of irrelevant paperwork, I told them none of it was required. The ONLY paperwork, from them, was a "full and final settlement" offer letter. They have now refunded my credit card and are sending me a cheque for the extra I had to pay BA for my Business Class tickets.0
