    Hi All,

    Just had my offer upped from £303 to £1489.03 after sending the following Letter and 'Statement of Littigation' that I designed. ;) Its £3.88 short but thats close enough for me!

    Oh Boy! I think they are going to get a lot of these now! :rotfl:


    Dear Ellie,
    Re. Account number: xxxx xxxx xxxx xxxx

    Thank you for your letter of 27th June 2007, where you failed yet again to appreciate that your charges are unlawful in value, not illegal in application! As such you will no doubt be aware that I have the law on my side. For this reason I still can not accept your dismal offer of £303.


    You charges should not represent an extravagance as any charge should not exceed the cost of the breach of the contract, which in plain English means, you can not charge me more than the cost of raising the charge against me.


    The only possible way you can legally defend yourselves against any part of this claim is to provide me with a detailed costing of the administrative process that added the charges to my account, as Yorkshire Bank have been asked to produce by Judge Iain Besford at Hull County Court earlier this month.


    Unfortunately until such time that you make this information available to myself and, should we get that far, to the court, I can not accept any offer less than the total charges applied, plus interest @ 8% as per my schedule, and a full refund of the £120 court fee I have paid. As of today, that now totals £1,492.50.


    I should also remind you that should you defend this claim and it is passed to my local court there will be a further £100 administrative fee that I will pay and you will become liable for. You will also be liable for a 'Self Litigation Fee' of £230 to cover my out of pocket expenses and time in researching and defending my case.

    This is great , I shall crib if I may.? I am claiming about the same and intend to start MCOL tonight. I have tried 3 or 4 letters now , more than I did with Nat West in attempts to negoitate Cap One just stone wall me with offer of £ 360 -and so to battle

    I sent a similair letter advising 'Ellie' (Renshaw ? If so same one as me :) ) of all costs applicable to enforced recovery action in the absence of forthcoming lawful resolution. In mine I mentioned a Wasted Costs Order to the value of £320 though. Full info and details on applying for this kind of order here for anyone who is interested:

    I dont think they are too bothered about the costs though. With interest and costs and a Wasted Costs Order (if applied for) it more than doubles my claim of £650 to £1368. It is ridiculous that Capital One employ such wasteful staff who are consistently losing the company money like this.

    I should be filing MCOL on friday if the ex stumps up his half of the fee so our claims will run pretty much together. Good luck :)

    I have recently won with cap1 i filed mt claim on 12/06 then they acknoledge the claim on the 20/06 but the date they sign it was the 16/06 21 days after the 16th i recieved a letter saying they was going to pay up in full!!!
    It will happen they was the longest 21 days of my life i kept thinking i will be the only one that doesnt win but when you do it is all worth while.
    I would of thought that you will hear something by the mid/end of july.
    Keep me posted!!

    As Cap 1 did not acknowledge my MCOL I pressed the Judgement by default button on Tuesday 10/7, how long should I wait before I start chasing them for payment.

    Ill sit and wait paitently then. My Acknowledgement was signed on the 02/07, MCOL says 06/07 so hopefully ill hear something week commencing the 23!!! justin time for my birthday and holidays!!! sport-smiley-001.gif Fingers Crossed!!!

    Should I complete the warrant part of the MCOL at this stage or only if they delay payment. I am very confused.

    If you have managed to get Judgement by default and not Rejected then Cap1 will be contacted by the court, if you don't hear anything within 7 days there is another process on MCOL that allows you to move on to the next stage and get the court to get your money :) This incurs further costs to Cap1 so its in their interest to pay up :)
