  • can anyone give me some tips against nationwide, claiming £3740, have sent 2nd letter after response from first was negative, 14 days nearly up so ready to file for court action, has many people gone to this stage with nationwide?

    I first wrote in March 07, used money claim online, Nationwide acknowledge then put in a defence. I recieved a copy of the defence last week, then this morning a letter saying they had put £2700 in my account, I phoned them and told them this was not enough, they informed me I had miscalculated, I checked, they were right. Full refund plus interest and all charges. Thank you Martin.

    Sounds like Yorkshire Bank, if so then yes.
  • had a letter this morning off abbey offering to pay 65% of claim as they say more or less that they are entitled to charge something and if i accept this offer as soon as they hand over the money they want me to withdraw my court action is this something they do all the time and should i accept just to ensure i get at least some of my money back or should i keep going and try and get it all

    hi
    filed on mcol on 30/4
    nationwide acknowledged on 3/5
    heard nothing so pressed for judgement by default on 5/6 (2 bank hols etc)
    nationwide defended on 6/6
    money started appearing in my account 14/6
    recieved letter confirming all charges to be paid back.
    got the whole lot back !!!

    hi all,

    this is my first post but i have been on here viewing and searching for a good while now,

    im looking for some reasurance (although not legaly binding lol)

    07 08 2006 - asked for statements
    not sure - sent letter asking for charges
    28 11 2006 - got usual letter, sorry about charges but they are fair, bla bla
    01 12 2006 - sent letter back saying give it up or we go to court
    12 02 2007 - filed with mcol
    26 02 2007 - intending to file a defence filed
    23 03 2007 - got hearing date of 29 06 2007
    15 06 2007 - at the last minute i filed my witness statements of all documents that i have and intend to use (now im scared)

    lloyds have not filed a defence or presented me with any documents that they intend to use, is this going to court,

    what can actually happen here and if they do present any documentation can i object to the judge as they have not filed nor presented this to me,

    hope someone can help put me at ease here, i keep watching the mail to see if i get a settlement offer but nothing,

    Has Martin made a mistake by not putting ( work out your Daily Rate) ? Hes not used any brackets with & (work out your Daily Rate inside).Hes put 0.021 when it should be the rate youve worked out.

    Also shouldnt it say on No:4 Under SECTION 69 of the County Courts Act 1984 instead of Under the County Courts Act?

    Martin has put the daily rate as a percentage. This means that there is nothing to work out, as everyones daily rate as a percentage is the same. You are putting the amount in pounds and pence. Both are acceptable, and mean the same thing.

    I would put 'under section 69 of the county courts act 1984'.

    That is why my POC was a mix of Martin's and the CAG, as i have picked the clearest bits from both.

    But your daily rate is £0.27. Forget about the percentage version.

    Anyway, have they made you redo it? I assume you have phoned by now. If so, put your POC in here for checking, taking out your account number.

    If they ve not filed a defence was you not able to request judgement by default at the time ? Usually you get a hearing date as they have filed a defence so it gets passed to your local court for one to be set :confused:
