The majority of the details have been uncovered from newspaper articles, presumably which the people involved have courted, or given their blessing to. The rest have been taken from public records. Not one piece of information has been gathered even so much as dubiously.0

I notice that after something of a contratemps on the "Kiya Survivors" FB page yesterday, since deleted, that Ms Butler has removed not only the comments about the tenant's immigration status and being "!!!!!" but also that the Kiya Survivors link has disappeared. I can only think that the charity now wants to distance itself from its founder, not before time imo.0

I must admit I do find her charitable work commendable. I do also find her all "hey look how great I am doing this". Nice to be able to do such things when lifestyle supported oooh so very well.
True heroes are like a friend I knew 17 years ago. She went on holiday somewhere (shameful of me but I can't actually remember where :O !!) anyway it broke her heart when she saw the suffering of the children there. She came back to jack in her nursing job, sold her possessions, went back and afaik she's never left since.

Yes, it would be interesting to find out if the Carmen Nobre will take legal action against her landlord for the breach of quiet enjoyment of the property, harassment and illegal eviction.
It would also be interesting to find out if Suzy Butler is taking legal action against her tenant for the alleged arrears and whether the allegations of extensive arrears with a previous landlord have any substance. The alleged sum of rent arrears in the recent past by this tenant across two different properties has been cited as in excess of £11,000 which in local market rent terms, means the tenant owes around a year's worth of rent,! (though this could include court fees on top.)
Also, it would be interesting to know if the tenant received any LHA during the alleged periods of rent arrears which wasn't passed onto the landlord. The maximum rate of LHA for a 2 bedroom property in Brighton and Hove is £843 per month.0 -
I have a theory...
I think that Suzy Butler is unable to produce any documents or back up any of her assertions with documented evidence (which is why she is confused, she has nothing to refer to) as she has sent all her paper and 'being a great landlord lolz' books to peru to be mushed up into pulp and used to build bridges/houses/schools/hospitals/medicine etc.
So whilst we sit here moaning about justice and following the law, think about all those people who are going over tenancy pulp bridge at the moment to get to their local peruvian tesco metro.

Whilst it will be interesting to read of the full *facts* behind this case ( if we ever do) , regardless of whether there are substantial rent arrears involved let's remember that the main reason this case has attracted so much attention is that, instead of fully acquainting herself with LL & T law prior to letting out her property, Ms Butler appears to have been slapdash in her lettings preparation and then chose to behave in a totally unprofessional manner when things went belly-up for her. For her then to act as if she was homeless, in order to garner support for the way she treated her T, was utterly nauseating, and an insult to those who genuinely struggle for somewhere to live.
As has been said many times, both in this thread and in the one which unfortunately got deleted, LLs cannot be seen to get away with harassing their Ts in the full glare of the personally invited media, mis-describing their T's true legal status & applying pressure on them to relinquish a periodic tenancy afforded to them under the HA.
Earlier this year a magistrate - ie, someone who really *ought* to have known better - was convicted of illegal evicting her T, apparently after a row about rent payments: add this sort of behaviour from LLs to the attempts over the past year by some LLs/LAs to publicly shame errant Ts - see a previous occupant of NL's Naughty Step - and it all presents a rather unpalatable picture. Quite apart from LL& T law, it is an offence to harass debtors:
Section 40 of the Administration of Justice Act
“S40 Punishment for unlawful harassment of debtors.- A person commits an offence if, with the object of coercing another person to pay money claimed from the other as a debt due under a contract he-
- harasses the other with demands for payment which, in respect of their frequency, or the manner or occasion of making any such demand, or of any threat or publicity by which any demand is accompanied, are calculated to subject him or members of his family or household to alarm, distress or humiliation;
THe LL needs to (a) know the law and (b) be seen to work within it when resolving rent arrears issues and dealing with evictions. No ifs, no buts.
There is a huge number of " accidental" LLs out there and no doubt many of them will feel that having watched Suzy B and GMTV they can take matters entirely into their own hands, should their own Ts give them any sort of grief.
