  • Yes she kept the award letter. But no she assumed they’d know if she was entitled or not.

Why would they know? That's not their job to know who's entitled to free treatment.

The exemption certificate is a credit card sized card, not a letter.

My girlfriend had sent her correct income details to HMRC and was told she was entitled to working tax credits including dental etc.
How was she advised she would receive free dental? did she receive the exemption certificate?
Tax Credits initially ask for the previous years income and the award notice comes with details of when to contact them re change of circumstances. If someone had a low income one year and a higher income the following, an initial claim may show an award due but when you advise them of the actual income for the year there may have been no award due

4 years later they asked for the info again and was told she wasn’t entitled to the working tax credits and want the 4 years worth of credit back.
Tax Credits are renewed annually so she would have been asked for details of her income every year, does she have ALL the award letters?

    What are her rights here?
She should now be billed the correct amount for the dental treatment with a possible fine.
Did she agree to unnecessary work being done as she thought it was free? would she have gone without a filling etc if she had to pay?

If it was the choice between a filling and food, she’d have chosen food.

As it was free she was happy to trust the dentist.

I think he was answering my question in post 12.

Foxwold - If she still has the letter, can she read it again to make sure it's accurate? Did she get an exemption certificate too? Can you answer these?

    I’ll ask now ta

He said she needed treatments that if she had to pay for (on a low salary) she would of refused.

So she must have told him she was entitled to free dental treatment ? Not the dentists fault then. Seems like she didn't understand what she was entitled to.

!!!!!!, I know she said she sent a raft of history and evidence to them.

Sorry I didn’t know if it was an A4, A5 or card size

She ticked ‘in receipt of tax credits’ which she was. That is it. She had been told she was entitled to them.

If that is wrong then ok.

WTC charged for late payment even though she was appealing. There words were "we make examples of people to get the money back for other people doing it who don't get caught"

Late payment of what? There are no interest charges on tax credit overpayments.

Was this on a phone call? If so who was she speaking to?
