Tax Credit Error

Hi,

My girlfriend had sent her correct income details to HMRC and was told she was entitled to working tax credits including dental etc.

4 years later they asked for the info again and was told she wasn’t entitled to the working tax credits and want the 4 years worth of credit back.

Over the years she thought the dentist was maybe taking the p1ss doing treatments knowing it was via working tax benefits, but she trusted his professional opinion. Where she would if questioned it other wise.

What are her rights here?

    He said she needed treatments that if she had to pay for (on a low salary) she would of refused.
  • She got fined £700 for faulsly claiming she was entitled to tax credit (even though HMRS told her she was).

    And charged £200 for late payment of paying it back. Even though she was appealing.

    WTC alone doesn’t entitle someone to free dental treatment. Is she disabled? Or also receiving CTC?

    Tax credits don’t charge penalties unless there has been a compliance check and the claimant has been found to have made a deliberate error. Sounds like there is a lot more to this story than what you’ve told us so far.

  • WTC alone doesn’t entitle someone to free dental treatment. Is she disabled? Or also receiving CTC?

    Tax credits don’t charge penalties unless there has been a compliance check and the claimant has been found to have made a deliberate error. Sounds like there is a lot more to this story than what you’ve told us so far.

    WTC charged for late payment even though she was appealing. There words were "we make examples of people to get the money back for other people doing it who don't get caught"

    No, it asks if you have a "NHS Tax Credit Exemption Card/ Certificate". Did she have one of these?

    Did she receive an NHS exemption certificate incorrectly, or did she tick a box at the dentists?
    Information is here re free dental and tax credits (needs to be with child tax credits or with disability element)

    on what basis do they say she was not entitled to WTC at all - insufficient hours? hobby business? income too high? Has she checked all the information on award letters are correct from each time she renewed?
