  • can anyone advise me regarding this latest letter from Marlin about MBNA £16k approx debt please. I sent the 12+2 letter dated 4th November 2008,heard nothing until yesterday...

    "We write with reference to the above debt and in particular your recent letter recorded in our office 4th Nov 2008 in respect of that debt.
    Please find enclosed a copy of your Application Form/Agreement regulated by the consumer credit act for your reference.
    We hope this is of assistance to you and look forward to hearing from you by return with your payment proposals to clear the amount outstanding."

    i am really confused...the accompanying form looks correct with my signature and details etc. Marlin were in default on 22nd December and seem to have snuck this letter in at the last minute!

    any help much appreciated...thankyou!

  • Sorry - I can't really help with the detail of this, but it sounds like you need a bump back up the board for some help.
    Almost debt-free, but certainly even with the Banks!

  • so sorry for bumping myself again but I am desperate for advice.i haven't been paid for christmas (as promised) so today i have less than £2 in my purse and have looked in every bag/jacket/drawer for more money....can't find a penny.i am alone at christmas and feel totally dreadful.

    hsbc are now threatening court action over another situation and i don't know quite what to do :(

    "i called today to serve you personally with a Statutory Demand on behalf of Arrow...i will return at 6pm this evening 24th December....
    If you are not at home on the above date I will effect substituted service at your address"

    What does this mean? please please please could someone advise me on what to do here...is this a bailiff?

    Also this is the Wikipedia meaning of substitued service:
    Service of process is the procedure employed to give legal notice to a person (such as a defendant) of a court or administrative body's exercise of its jurisdiction over that person so as to enable that person to respond to the proceeding before the court, body or other tribunal. Usually, notice is furnished by delivering a set of court documents (called "process") to the person to be served.

    Do you know who Arrow are? This may be just serving court papers. Sometimes they come in the post and sometimes are hand delivered. (just
    like divorce papers). Crappy that they are doing this today. Don't let them in - an expert on here will be able to let you know if you should be there to accept the papers. They may just be a collector hoping to catch you - pre looking at ccj's from the way its worded.

    The DCA's do seem to be active at the moment, but they know that things will be worse next year and even more will go BR.

    I wish you luck, the fear is the worst thing. I hope you have somewhere to go tomorrow. Please don't sit at home alone.

  • thankyou so much for responding to me..was starting to think no one on here likes me:( just been feeling so alone and sad ever since this awful letter arrived...on christmas eve of all days.....!

    arrow are the dca for MBNA who sent me what looks like my cca just days before they were about to go into default. they have employed uk debt and legal to recover the money i think. i am a bit calmer now and will lock the doors and stay inside - i am scared to even go back outside in case they are out there in the street.
    what do i say if i am asked anything outside by them?
