Landlord not paying Mortgage!!!!

    I had this years ago whilst at Uni.

    The LL had bought the house on a residential mortgage, got th mortgage fraudulently (amongst other things), did 2 years in prison, his wife divorced him and so when released rented out the house to me plus fellow students (where I came into the picture) - but then didn't pay the mortgage.

    It was repossessed and put up for sale - nothing the tenants could to - mind you that was in 1990 so things may well have changed since then!

  • Unfortunately I don't have all my CeMAP material with me, but this IS an option available to the Lender if they are not getting the money from the owner.

    Fortunately I've never had to look into the details as I've never had a client in this situation.


    The tenant is effectively good for two month only, not 1 month into a years contract.

    I'm pretty sure that the lender would have to show that they couldn't track down the borrower before this happened.

    I'd think carefully about witholding it and even more careful about telling her that you opened her post and discussed the in's and out's of her finances with her lender. I'm vey surprised they spoke to you at all.

    Again, what would you have done if she had asked you to leave in 2 months and given your deposit back??

    No different now - yet millions more people seem to be in the kaka even without the interest rates going up.

    I wonder what 10% would bring?

    before she moved she i used to send her all her mail to her address at my expense, then one day she texted me to say she was moving and if i could leave the mail at my address until she gave me a new address. but she never got back to me. then one day she said she was coming to pick up the mail but never turned up.
    so im doing what she told me to do. im not in the wrong.

    also if she wants me to go she will only give me one months notice.

    i could move if she gave me my deposit back. but what im trying to say is if shes not paying the mortage and we are getting debt collectors to the house how is she going to give me my deposit back if shes got no money.

    i would be happy to give in the notice if i trusted her to give me my money back.also the deposit is more than the rent.

    Your priority is yourself and your child. The landlord has behaved appallingly and placed you in a vulnerable situation. Witholding rent for two months should equip you with the finances to put down a deposit somewhere else. I think Housing Benefit may be able to help you out with moving costs. Ultimately you are going to have to move and better to start the ball rolling on your terms rather than someone elses. Being dumped in a B&B by the council would be awful.

    If you are going to find all this very stressful, month after month, not knowing what your future will be - then i would look for somewhere else to live if i were you - and i would do it soon. you have no idea how quickly the lender will act.

    the council may have a BOND board which may loan you the money for a deposit, or provide a "Paper Deposit/Promise" for your next property

    dont get bogged down in details about letters which are for her - nowt to do with you.

    Here we go.

    Redirection is what should have been done to the post, and as soon as you couldn't get her then put it in the post don't hoard it.

    So, in summary, pay the rent, and wait until you receive notice, in an case you have two months to get out, withold that amount of rent to cover the deposit only. Seems quite simple really.
