Captain and Barnaby..This thread is not a debate about rules and regulations.....We can do that elsewhere if you like..
It is about helping someone who has had difficulties and would like to know how she should proceed.
Put your efforts into coming up with a solution..
I'm normally harsh, but not everything is black and white

I was tryign to point out that if she has absolutely nowhere to go regardless of the section 21 she can stay longer and in doing so may increase her chance of tenured accommodation which may well be a last resort option0 -

Lead on MacDuff.
And a solution for who? there are two sides to this story, the one told by the poster and the LL's take on what is happening - between the two of them there appears to be a difference- but I cannot judge the LL as being unfair without knowing more, not just little dribs and drabs.
Help is one thing, but I cannot sit back and listen to someone tell the OP stuff the LL and stay put and wait for court process to take place.
If the law allows the OP to be slung out, it also appears that the OP may be entitled to a "windfall" for the TDS violation, other than that there is no right and wrong answer.
I do know however that this story is more complicated than first sight may suggest.0 -
I reiterate.
OP speak to your LL and say you have cleared the arrears and there won't be any more, and take it from there...A section 21 may have been a scare tactic to make you pay (which worked)
Just don't miss any more payments otherwise you will be living in a hostel

Why nowhere to go, deposit back and start again, but you now seem to suggest that the OP has to rely upon the CC to obtain accomodation?0 -

Even those that are mortgageable find the properties they could have afforded have been snapped up by LLsCaptain_Mainwaring wrote: »I'd suggest that if building societies are more flexible than LL's then the tenant takes the plunge and buys a house, then they just ring up and tell the BS, and don't risk action by the LL.

Because council/HA accommodation is practically the only accommodation available with decent tenure as ASTs are rubbish. Given she has kids and schools to consider and a local job some stability is probably desirable. If she wants properly tenured accommodation conducive to stable family life and can not afford to buy the council/HA is probably her best option. She has already said she has had no success finding privately rented so far. Where I live most landlord's do not allow children or pets and it can be very difficult to find somewhere especially on a limited budget in a two month period.0 -

And usually people have to find the deposit for the new rental before getting the original back which can be an obstacle....0 -
There isn't enough HA/council accom to go round, so those who are earning tend not to get it. There are many, many families living happily in private rented. Remember a lot of people in employment with families don't actually want to live on council estates.I'm a Forum Ambassador on the housing, mortgages & student money saving boards.
