One last thing while I get everything off my chest - the cheeky so and so is sitting on 17 grand following redundancy from last Nov. This was due to pay off some debts and her car loan, the loan is in my name and I am still paying it whilst she drives around in a fancy car....she must be thinking what a !!!!!!!!!!!!!!!!!!!!!!!!0

Guys - trying to pick up on a few questions in the prvious posts:
Wife is not on any income support etc so I am aware this is a private claim

Appreciate the comments regards ex wife living apart etc but we are still legally married and still in same home - so how can my latest demand (now based on 2/7ths discount) say I am not resident in the home ?
I found that faxing everything through to them and then sending it recorded delivery worked for us - it was still a slow process but they really didnt have a leg to stand on! Ask them exactly WHAT they need to see to prove your residency and go from there - to be fair to them though if your ex is telling them a different story, then they are only going on the details they have.
Mailed my MP 9 days ago, no response. Am due to send another mail tomorrow
Look up your MP's website, you should be able to get a phone number for his secretary. I would suggest calling rather than emailing, i you can get the secretary on side you usually get seem quicker!
She does work part time out of choice, refuses to take on extra work which she can easily get as she is a nurse
The CSA wont take this into account, bear in mind that the government mandate currently is that no parent with children under 16 should be forced into work. As she currently does not claim benefitsm then there is no mechanism to even broach that subject. One note of caution though she may well try to apply for maintenance for herself as she only works for a few hours a week, and that is in addition to the house and part of your pension should you have one.
Latest situation being-all bills for the house now not being paid (cant afford to). She takes them abroad on holiday in around 2 weeks, will not tell me where, when, so may get home from work one day to find kids gone!!! Cant book a holiday myself as one cant afford but 2 she has taken all the kids passports and refuses me access to them.
I would seek legal advice ASAP on this one - as a parent you have the right to know where your children are going, and she has to seek your permission to take the children out of the country. (the UK is their residency and therefore they should not be removed) We had this one with my husbands ex and the judge told her that if she did it again he would jail her for kidnap!
Once again sorry for the ramble-but really am worried and the stress is starting to affect my job/health...sorry folks
Have you tried to talk to the CSA and explained that this will cause undue financial hardship? They are obliged to take the interests of your family situation into account, and not penalise you unneccessarily.

If she is driving around in the family car which you are paying for then you need to report it stolen. Registered keeper does not mean legal owner. Take her off the insurance. If she needs transport then she will have to use her maintenance money to pay for a taxi! Play her at her own game.Sealed Pot Challenge #817 £50 banked0

In some ways this is your greatest concern at the moment. How sure are you that she is going to come back with them? How sure are you that she is going abroad/on holiday ... and not relocating somewhere else.
You need to see a lawyer about getting some sort of prohibitive order put in place. If need be, cancel the passports if you are really concerned about her motives. I know, it may be that you are jeapordising your childrens' (possible) holiday ... but you also have to act in their best interest too.0 -
Appreciate your commentws CSA. Have emailed MP again today and as you say will continue to do so until get response. Have also sent the csa a very long rambling letter making refernce to the child support act 1991 - should keep them busy for a bit. Concern at the moment is they have not sent me the standing order I requested 7 days ago and worried how quickly they would issue a DOE to my employer ? ? Anyone any ideas on that one ? ?0

The car loan - when did you take it out? This can be grounds for a variation - debts of the former relationship whereby you are liable for repayments on items such as a car, for which the PWC still has the benefit of.0

Thanks Kellogs - did not now about such exceptions until today when a exceptions doc was received from the csa. This came with a compliment slip stating the csa may be able to make an adjustment based on loan and mortgage payments. The loan is a possibility but it only applies to NRP and that remains my big argument with them - I am NOT a non resident parent. The other part being the mortgage this can onlt be claimed again if I am the NRP but also if I no longer live in the house, which clearly as I am not the NRP and do live in the house I cannot claim for.
Anyway have sent back the form incomplete along with my very very long ambling covering letter

Someone mentioned earlier in the post to take her off the insurance this is in her name as is the car, it is just the loan that I pay in full - if it was on hire purchase wouldnt be to bad as would just stop paying and tell them to reposses the car.........0 -
But I thought that as you pay the loan, the car belongs to you. Like I said, registered keeper doesn't mean legal owner.

Not sure what I can do on the car side - spare keys, all paperwork etc have been hidden away by me "lovely wife" so for me to attempt to sell would prove very difficult.
Hey some good news for me though - received an email from my MP today stating he is writing to the csa for me and will let me have detail of there response............ Does this fill me with some hope ? ? ? ?0
