    Child Benefit will not automatically be awarded - especially if it is already in payment to somebody else. There will need to be an investigation and your ex's consent for it to be changed. They will not change it if there is any doubt. It will be suspended whilst they investigate.
  • I have no advice to offer, but I think it stinks that you are having to go through this.
    Could you not speak to your ex and tell her to stop the claim untill the divorce is settled and you have joint custody of the kids?
    Does the child benift go into a joint account? if so you could say to the csa that although the benift is in her name the money goes into a joint account and so is paid to you also using the thread that if a bill that was in your name she would effectively be paying it using joint money?
    if you and your wife can come to an agreement between yourselves then csa dont have to be involved at all

    I know how you feel KAP. Just got back from the docs with a couple of packets of betablockers because I am so stressed. What sort of scumbags operate the CSA?

    Well guys have run out of patience with the CSA - now been threatened with a DOE order if no payment made in next 4 days. My right to appeal is still open to me - but suprise suprise I still have to make all the payments whilst this all goes through. Guilty before poven innocent and if payments are made and I succesfully win the appeal (which I doubt) how and who do you reclaim the money off ? ? No chance of getting it back off her !!!!

    Anyway had to bite the bullet and have now cancelled every direct debit on the house inc mortgage. Have never been in debt or missed a payment in 18 years and now this. It will affect the kids, no food being bought by me this week, both of us may end up with credit rating problems all because she was a greedy b##ch and the CSA are only interested in meeting targets and refusing to make common sense decisions.

    Have left her a not confirming all this (she refuses to speak or acknowledge me) gets a text back of her "further to your demand send to my solicitor". IS SHE HAVING A LAUGH ? ? ?

    Oh dear. I am sorry for you KAP. Your ex wife sounds incredibly unreasonable.

    your situation is horrendous and the CSA are so incompetent it's almost laughable - I am so sorry that they are not doing anything to make the situation any better for you.

    Is you ex partner / wife iro income support at the moment?? If she isn't then she has contacted the csa herself to make a claim. If you are no longer living together as husband and wife and she is the one receiving the child benefit she will be classed as the primary carer and can therefore make a maintenance claim if she wishes. With regard the shared care in this instance for an allowance to be made the children have to be in your sole care at the property i.e if their mum is away for the night etc. If it is possible you should talk to your ex and try to sort something out about the children if it is possible. If not then you could put a claim in for child benefit. You would then be classed as the principle carer.

    Just read through the whole thread - sorry to say it isnt really the csa's fault - the law states the principle carer can make a claim for maintenance - it appears its ure ex who is being unreasonable. kick her out - problem solved - perhaps when all you pay is the maintenance and no other bills she will change her tune

    Problem is if she is low paid due to v p/t work she will do what my husbands ex did and get legal aid. She will then be able to bombard you/your solicitor with endless trivial letters and it could end up costing you a fortune-my husband had to answer 3 or 4 in one go be able to afford to answer at all! Also think carefully about what access you are asking for and whether it is in the children's best interests-being shipped from one house to another like a packet of cornflakes,half here,half there can be very hard on them.

    The CSA are a law onto themselves. We have suddenly had a bill arrive for arrears for a period where we have documentation stating he had cleared his arrears and had been assessed as nil as I was off work on unpaid maternity leave and he was supporting 3 children here.6 months on from acknowledging those facts,they are still sending him final demands.Meanwhile his ex lives in absolute luxury with her new bloke (the one she was having an affair with,which is what ended the marriage) the children want for nothing whereas we are mostly hunting around for every penny.

    I hope you get a good result from this.
    Women like her give the rest of us a very bad name.

    Guys - trying to pick up on a few questions in the prvious posts:

    CSA office is in Barnsley or Bradford ? ? (sorry paperwork kept out of reach of certain people) I do know it acts as a overflow for Birkenhead..sorry a bit vague on that one.

    Wife is not on any income support etc so I am aware this is a private claim

    Appreciate the comments regards ex wife living apart etc but we are still legally married and still in same home - so how can my latest demand (now based on 2/7ths discount) say I am not resident in the home ?

    Mailed my MP 9 days ago, no response. Am due to send another mail tomorrow

    She does work part time out of choice, refuses to take on extra work which she can easily get as she is a nurse

    Have submitted my own claim 4 weeks ago online - guess what despite having a reference the CSA never received

    Latest situation being-all bills for the house now not being paid (cant afford to). She takes them abroad on holiday in around 2 weeks, will not tell me where, when, so may get home from work one day to find kids gone!!! Cant book a holiday myself as one cant afford but 2 she has taken all the kids passports and refuses me access to them.

    Once again sorry for the ramble-but really am worried and the stress is starting to affect my job/health...sorry folks

    I think you really need to get a family lawyer involved in this KAP...even for the first interview as it is free. She is not playing fair especially where the kids are involved and it seems to me she is trying to push you out the marital home.

    You need to get things sorted re the house and the children. A lawyer won't touch the CSA stuff unfortunately.

    Chin up petal...we are not all like that I promise you :)
