Anyone a CSA ?

Hi all,
Some advice if anyone knows the answer to this one......PLEASE
Still married (divorce still going through) still living in the same house so still have full care and access of my 3 kids. She has applied to the CSA and they have now advised me of my weekly cost. I have advised them I am still living with my children, that I still have shared care, I am still very much involved with ALL their activities etc etc I currently pay all the household bills and we take it in turns to buy food. The amount they have requested I simply do not have. I think the main question being do the CSA have any right to be involved in my case to start with as currently there is no NRP ? ?

Well ... the CSA do have a right, technically, because your ex ( to be) has asked them to be involved.
Do you intend on remaining in the matrimonial home? If you leave, will your ex2be be on benefits?
In making their assessment, were the CSA made fully aware that your children have 7 out of 7 nights contact with you ... in which case, the assessment should have come back as zero.
Perhaps you should stop paying all the household bills ... and let her see how much you are worth to HER children!:wave:0 -
Yep my intention is to remian in the home (will it happen is a different matter) Chances are she will claim some form of benefits, she is a nurse earning a decent hourly rate but only works 1 an a half days per week.
Still going through solicitors re child access agreement. Have considered your point regards household bills, was unsure what to do but looks like the good old CSA will force my hand on that one and leave me in a difficult situation with my children.0 -

Have you considered fighting for custody/residence of your children ... and in turn forcing her on to the back foot? Just because you are a bloke, doesn't mean that you are not going to 'win'. I say 'win' loosely, as there are no winners, as such.

Current situation being on custody - her offer (how sad is that when we talk about children) is for my access to be evry Wednesday and alternate Friday/Saturday so a total of 4 nights out of 14. I have never asked for more than an equall split and have suggested me every Wed/Thur/Fri and alt Sat nights.
I am prepared to fight all the way for this access, would ove full access but do not feel this would be in the childrens best interests.
It is so good to here blokes do not always loose out. Hey thats all still to come and here I am now sick with worry over the bloody CSA, nerves are shot already.....0 -
I would write back and say that you are still living as a family unit, there is no NRP and request the case be closed.They deem him their worst enemy who tells them the truth. -- Plato0

This is complicated and is normally based on what income support determine - whether you are living as a household or maintaining separate households. It certainly used to be that if you lived in the same house as your children then you could not be deemed to be non resident - not sure if that has changed,0

As there is no defined PWC or NRP yet as you both still live in the same home you could either
- Counter claim it, if she works she can be assessed too. I doubt it would get you far but its more of a 'taste of your own medicine' tactic.
- Leave.
- Ask her to leave sharpish, in order to rent out the spare rooms to be able to afford her maintainance demands
- Consult a legal advisor (with out her knowledge) and push for joint custody

Thanks for that Mary - have just submitted my counter claim (tit for tat and all that) Refuse to leave the home because of the importance of my kids. Unfortunately no chace of her leaving (I wish) so am in the middle of trying to get those lovely understanding people at the CSA to open up a review of the case. Fingers crossed hey because am sure like a lot of people affected by this I aint left with a pot to you know what in ! ! ! :mad:0
