Well, - all I ever tell tenants on here are their legal rights and LLs legal rights - if you see this as "stitching up" a LL then you must have had some poor experiences.
"Tenants problems are not LLs responsibilites - who else other than the LL is responsible for evicting a tenant !!!
i am assuming that this LL's stated reason for wanting possession is the truth.
Many local authorities will NOT rehouse tenants until a Bailiffs warrant has been issued - i have personally seen this several times, and read it many times in various forums and magazines.
A friend of mine was offered an empty Shipping Container for his wife and 2 kids under 8 when they were repossessed
Local authorities will do any thing they can to avoid housing folks.0 -

The LL may be lying about why he needs to sell, but that is none of our business. If he canot afford the repayments, and the lender reposseses, the tenant will be out in a couple of months anyway....
..But who cares..the tenant gets rehoused..the LL is b.uggered for thousands.
A valid s21 is enough to show a tenant will be homeless but not necessarily enough to allow the council to sort it out. Many authorities find applicants intentionally homeless if they leave before the possession order is granted and others will insist on a bailiffs warrant so Clutton is doing tenants a favour by ensuring they are aware of the facts before they leave. If a tenant comes on this site and asks for advice they should hopefully get it, not given advice that may make their problems even worst.0 -

Yes I have had one poor experience, as I know you have... The difference is that you 'manage' property for LLs and its not your 10K you are going to lose.
I am very doubtful as to whether you are a LL or just someone with a lot of time on thier hands, and reads a lot of forums/magazines!!
I do feel for the OP and have offered legitimate advice, but you feel the need to condemn LLs.
If the LL loses the property then the tenant is on the streets anyway...Seems like this is what you want ..dunno?

Assuming that you have an AST.
On the day of the court hearing for your eviction make sure that you are the first in the queue for the doors opening.
Ask to speak to the duty solicitor.
Have with you a financial statement showing that you will be able to pay your rent arrears at the rate of say £10 per month.
Be nice to the solicitor and judge.Living Sober.

With at least 2 months rent arrears and a correctly served section 8, the tenant would be out. Pru - they had been repossessed by the High Court on Monday at noon and the court had to order them to leave by Tuesday at 2.00pm (1993) - judge said it was the worst case of harrassment by a Lender he had ever heard and he wished he could have given more time but legally could not . This poor guy knew nothing about his rights and he and his family slept on mates floors for several weeks till he got a rental and then when he asked the Benefits Agency for an emergency loan for a deposit they said that was not an emergency matter and said no ...........
