    ive stopped paying one of mine until they produce it, ive sent them a letter telleing them the account is in dispute and therefore they shouldnt be chasing me - or that im obliged to offer any paymemt,they shouldnt add charges or interest or pass it onto another dca,,,, put everything in writing and request from now on that all correspondence in writing only to you and from you, any other calls will be logged - ive also sent a harrasment letter and thus so far no more phone calls,

    found lots of legal stuff there and lots of help too,

    but if you wish to have a letter i can pm it you no prbs if you pm to let me know

    dont despair, its just i believe they shouldnt have the debt to chase if they dont have all the paperwork with it, but dca's will try all sorts believe me

    anyway other thing you can do if they dont play fair, then complain to oft and ts too

    like you i was scared a few months ago, but now with more knowledge gained im immune in parts from their threats , its just that at the time you are scard because of the unknown, believe me i know how you feel,

    take a big breath and relax a moment, like you have already had a phone call and its just that they want you to feel scared and threatened, they want you to pay as much as they can get out of you ,,,my guess they are on some commission based salary,,,,

    like ive advised bigdi, i suggest you also request a copy of your credit card agreement, with a 1.00 postal order and send it i did via signed for delivery , and they have to supply you with a copy of your agreeement , if they cannot or take more than 12+2 days they are in default, you can pay them what yo can if you wish, i have myself stopped the payment on principal because of the silly telephone calls i had, see my post above to bidgi for other info

    pls read all you can about debt collection guidelines and also you will find a lot of their threats are just that,

    Can I join please? I contacted CCCS on Monday and they suggested a DMP, I have read the booklet online but havne't received anything through the post just yet. The DMP is for my partner and I, we don't actually have any joint debts and most of it is mine but because we share all our money, we were both really struggling so I was glad we could do a joint one.

    So do I write to all my creditors? I thought CCCS did all that? Sorry not too sure how it all works now :o

    Hi HT ... I just ignored those, they're standard system-generated letters designed just to let you know your DD isn't in place anymore. They don't mean anything as far as your DMP is concerned.

    Hi Hayley -

    Sort of both :) You don't need to do anything for now; CCCS will send you a pack through with a template letter for you to send to all your creditors. They will also contact your creditors with the offer of payment. You then wait for the two to come together and your creditors to accept the offers/your DMP situation.

    Hi,

    This DCA is the scum of the earth. Very very nasty people. You will be in for a rough ride but if you know your stuff and play them at their own game then you will be ok.

    As Maz has said, request the CCA from your account. If they dont have it, then the debt will be unenforceable and they cant persue you. Also, inform them that you require all communications in writing and not by telephone. This should stop the nasty calls.

    Search the forums for them and you will find lots of threads on them. Report them if they break the rules. The quicker this buuch of low lifes lose their credit license the better!

    Thanks Cocker100. I've only received one phone call from 1st Credit and as I said, the guy was very threatening. Its early days and I'm expecting them to turn the heat up over the coming few weeks.
    The acid test will be if they issue a Stat Demand, as that will prove whether they are bluffing but with my house in severe negative equity I can't see how that will be attractive to them. I feel the time to request the Orginal credit agreement is if and when they issue a Stat demand. I can't see the point doing it before then, but I'm pretty naive to all of this. Thanks again.
