    Hi all,a little worried, despite several letters to Lloyds telling them about my dmp, yesterday recieved a letter from Lloyds solictiors saying that if i did not pay back the amt owed on overdraft they would take me to court. Has anyone experiened a letter like this?

    Cloudnine, I am reclaiming charges from all the creditors on my DMP. I was scared about this too. I sat for a year wanting to do it but scared to take the step. I'm pleased to say I've had great success and am getting my charges back without much effort (well apart from Cahoot and Creation Finance who I have referred onto the Ombudsman). The money refunded goes towards the debt with them.

    Give it a go.
    Have none of them been more difficult over the DMP since you did it?

    Hi ex-spend - is there a standard letter that you sent to your creditors, or a link with a template on?

    To be honest I only started the claiming process in June so it is early days. Having said that I am pretty confident all will be ok. At the end of the day they have agreed with the DMP and also they can't take what I don't have.
  • The process is easy

    1. You send a letter asking for information on your charges. You send £10 postal order or cheque with it as this is the maximum they can charge. Someone will take the £10 others will return it. They have to respond within 40 days.

    2. You send a letter detailing the charges and asking for them back giving them 14 days to reply.

    You will the probably get a letter saying "go away, our charges are fair" - so you send another letter saying you are giving them 14 days then instigating court proceedings. Or you may get an offer of less then you have claimed - don't accept this, you can get the whole lot back. In some cases you will get the whole lot back straight away.

    3. You write a letter saying you will take them to court.

    If you don't get an offer then you either start the MCOL process or go to the ombudsman.

    hiya all today hope the weekend went well

    hi EX Spendaholic - many thanks for you last post brill - will keep on the back boiler for my personal circumstances for the time being

    just out of interest now ive fully digested the guide, did you ask for the interest too in your credit card claims?

    im tempted even though im on the debt plans with all my creditors - just feel im ready to tackle this side, but as i havent got all my statements, im first asking for full sar and data info, and also the credit card agreement first,
    as im viewing if the debt is first enforceable or not, as im persuing that angle first - then i can see about the charges and then offer a full and final settlement via a relative who wants to help me out in getting rid of my debts.

    also can i pls ask about the halifax re hardship, as im on incap benefit at the mo, but my husband is full time working, our joint account with halifax ,ive written to them last year but have suspended my claim at halifax, im wondering could i in effect claim the hardship route even though a joint account, not sure if i can though?

    just a thought anyone else?

    Thick grey paper? They are not proper solicitors they are a department within Lloyds credit team. I would copy them with a letter offering them a payment plan, you get this letter just before they give in and accept its there last push.

    I have never come accross anyone on a payment plan who Lloyds have took to court. Someone who worked for Lloyds said the same too but I know its freaky when you get the "grey paper" letter.

    Thanks for that, what have you done in the cases where it has been passed over to a DCA?

    Received a "formal notice" from Hellifax today, is that like a default?! Because we are £150 over the limit, funny that since they owe us nearly £600 in charges.

    If I have all the statements, then can I fire the letter off straight away for a claim?

    I have had "formal demands", "enforcement notices" and "defaults" all from my Lloyds current account which amounted to nothing but not a formal notice so not sure - sorry!
