Unjust Parking Fine - Info and Action please
Not the usual money saving post I know...but you might help me save at least £750, possibly £150 or even more... after receiving a parking fine - THROUGH THE POST from a private company
I received it yesterday from City Parking Enforcement of Borehamwood... with a PO box address or automated telephone number demanding payment of £75 in 14 days or £150 with 28 days.
Apparently I had parked at their clients (Lidl Supermarket, Welling, Kent) for longer than the allowed 2 hours on the 25th September from 6pm to 10am (so in other words over night!!)
I did not do this... I'd rather sleep at home just around the corner and with my car parked outside! Also I had been at the store at 11am on the 25th for about 20 minutes...and had also been at the store the previous evening around 6pm, again for about 20 minutes. So it appears that the company also has the dates wrong but also seems to think that I stayed throughout this period.
I have the receipts still to prove that I was at the store at these times as a customer but the company have photographic evidence that presumably proves I stayed over two hours..... I can't wait to see it...as it obviously is a fabrication!!
So as far as I am concerned I went shopping stayed the minimum time that I really had to (I hate shopping) but still got more bargains than I bargained for!!! though I joke I was far from happy yesterday...
I am also angry that this company...despite me doing nothing wrong were able to get my details from the DVLA and are threatening further action if I do not comply within the time period.
There is nothing even ambiguous about this case, this is either a simple error or the company are simply trying to rip people off...
The PCn is quite threathening in itself and with no means to discuss the matter except in writing to the PO box address I think many people would just pay up.
I think this is outrageous and have written to the company outlining my reasons for not paying and also asking for the photographic evidence. I have passed a copy of my letter to the local Lidl Store amanager (he wasn't very interested) as well as sending a letter to LIDL UK (who are based quite close to me and will be receiving a personal visit from me if I don't hear from them or City Enforcement).
I'm not sure what I going to happen next.... I really could have done without this sort of hassle at the moment, but I will fight and fight such an unjust fine.....
....erm any suggestions on how I can do this please?

Just ignore them - I saw a thing on the news once, if they take you to court they have to prove that htey suffered damages or inconvenience as a result of your actions and would probably not fine you more than £1.0

do nothing, they say they've camera footage when you say you weren't parked there. if you weren't then they can't prove it.0

I work for local council in london ( Parking Services) i would be happy to help with you deal with this fine. A friend of mine recently got a parking fine was parking in lidl as well which we i got cancelled.
First Step
You need to write to the company as the Road Traffic Act allows you the opportunity to make a representation. Do not ignore the notice as it will not go aways
Points for your letter
1, Ask them to provide evidence and parking attendants notes that contravention occured such as road tax detials,
2,A copy of the Traffic Management Order relevant to the loaction where the vehicle parked
3, That you willing to go an independant Adjudicatior for the case to heard.

To me the case is clear and the fine should not have been issued but then the company may not see it that way - in which case I think Lidl would probably intervene...... but then they might not....0 -

Trouble is if you do nothing they will keep increasing the fine until it comes to court. As a previous link mentioned they had their day in court and won but had 2 years of stress.
Something should be done about these companies. Clamping was all the rage for ripping people off but now they just issued blooming tickets with no evidence. Laws need to be clarified so people fully understand their rights.~Laugh and the world laughs with you, weep and you weep alone.~:)0
