  • Victor - definitely go to the next stage of complaint. We did this on behalf of a client and he did get some financial recompense. Not the same scenario as yours by any means but we were complaining about wrong advice given verbally by a planning officer and we won. Our client got the fees back that he'd paid to us as if we'd been given the correct info in the first place an application would never have been made.

    Someone in the planning department has made a mistake and should be held accountable - why should you have to suffer the consequences. Sorry, but it makes by blood boil !!

  • Thanks Marybishop for that. I am going to make the following point in my next complaint :-

    In one of the emails from the planning officer from a few months ago he says (post 132! page 7)

    "At no point in your letter did you mention any issue regarding
    boundaries of the properties, even after you had inspected the plans."
    and...
    " If the matter had been brought to the attention of the Planning Department when the footings were being dug, perhaps something could have been done at the time, but the matter would now have to be dealt with under Civil Law."

    I'm therefore going to say that without the benefit of the site plan how could I or indeed anyone have known the exact position of the extension in relation to the boundaries before it was built. He has admitted that something may have been done about this earlier if I'd have had this information. ( I did actually phone the planning department as well and tell them that the footings were on my land and they said that that was ok so long as the wall wasn't.)

    Can anyone think of any other points I could complain about?

    Well personally Id bring in that they blatantly lied - erm misled you - during the phone calls you made concerning inspection of the site by an enforcement officer.

    Totally agree Victor. We deal with various planning authorities and believe me they do vary! And the turnover in staff in one council is phenomenal - no wonder the advice is so inconsistent! Doesn't excuse mistakes like you've had to put up with though.
