Where folks have used a property to fund a lifestyle they will run into problems with Income Support because of these clauses:Income Support can only help with the interest on:
- loans for ‘acquiring an interest in a home’
- or loans for financing repairs or improvements that are necessary to maintain the fitness of your home for human habitation
- or loans taken out to repay loans that were used for either of the above
A replacement mortgage would only be met to the same level as the original mortgage. For example, if the new mortgage or loan is used partly to clear debts or to replace a loan not previously met, this would not be allowed in the cost of the second mortgage. See leaflet IS8 Home owners – help with housing costs for more information.0 -
well if the op has a house and has a mortgage on that house it would be difficult to argue that the mortgage was taken out for any other purpose, doesnt sound as if she is funding a lifestyle, just buying a house0

We have never remortgaged for any purchases or home improvments (the house is very 'basic' and we only own a cheap second hand car. All our furniture is second hand too.) The original mortgage was taken out just to buy us a home less a small deposit.
My husband has to take his holiday allowances to accompany me to hospital appointments etc or when I am struggling to cope at home and I have asked him to take time out from work for a while as I need his help but he is reluctant as we do not want to worsen an already dire situation. Also if my husband is out of work and we lose the house it will be more difficult to secure rented accommodation.0 -
I too would go back to the CSA. I got a letter from the CSA saying that my son`s father can only pay £0.00 due to his housing costs and the fact that he has another child who stays with him..she is only there 1 in 3 weeks but half the holidays which must amount to the 2 nights a week. There are people who know the rules and flaunt it to avoid payment but you seem to be one of the genuine ones.0

We have involved our MP to help communicate with the CSA on our behalf as the CSA just ignore our letters and refuse to answer our queries. They have been more co-operative since the involvement of the MP but we are still getting nowhere fast.
Maintenance assessment went down £20 a week in January, it was implemented in May, were reassessed in May and yesterday a letter arrived from CSA with the new maintenance figure - increased by £20 a week.(It will only take a week to implement that change I'm sure!) So all in all my husband will be paying just less than £100 pw in maintenance and arrears.
I just cannot fight them any more. There is no way we are going to have enough money to live on before the youngest child reaches 18, so I give up. There is certainly no way of clearing our debts so bankruptcy is the only answer with regard to that but then we still cannot afford to live on what the CSA leave us. Might aswell invite the bailiffs into our home tell them to take what they can find and then just go down to the housing office and wait there until they suggest somewhere we can go. There is no answer to legalised extortion.0 -
if you pay what you can, rather than what the CSA says you must - what happens then ?
if they take you to court - surely you can then argue your case in front of a judge0 -

I'm afraid it does not work that way. They slap a deduction from earnings order on you and take it direct from wages.0
